If you are planning toget a divorce, mutual divorce should always be preferred to a contesteddivorce. Obtaining divorce through mutual consent is quite advantageous as itsaves both time and money. The provision for dissolving marriage through mutualdivorce in India is included in Section 13 B of the Hindu Marriage Act by theMarriage Laws (Amendment) Act, 1976. Any marriage solemnized before and afterthe Marriage Laws (Amendment) Act, 1976 is entitled to this provision.

Mutual Divorce is to be filed by the couple only after theyhave lived apart for at least a year. A petition supported with affidavits fordivorce should be filed in the district court by the both the spouses. Thehusband and the wife should jointly state to the court that they are unable tolive together as they are facing immense difficulties in adjustment.

The filing of divorce petition by both the husband and thewife is legally known as the "The First Motion Petition for Mutual ConsentDivorce". "The Second Motion Petition for Mutual ConsentDivorce" mentioned in the sub-section (2) of Section 13 B is filed whenthe couple reappears to the court for the second time after a period of sixmonths. If the judge is satisfied after a hearing from both the husband andwife, the court announces a mutual divorce decree.

Awarrant is an order of the Court to arrest a person at any place he is foundfor being accused of an offence.

Thewarrant of arrest is in prescribed form.
Therequisites of a valid warrant are as given below:
The warrant of arrest shall be inwriting.
It shall be signed by the presidingofficer of the court.
It shall bear the name and designationof the person who is to execute it.
It must indicate the clear name andaddress of the accused.
It should state the offence with whichthose accused are charged.
It should indicate the date of the issueof the warrant of arrest.

Thewarrant once issued will remain in force till it is executed or cancelled.

Amagistrate is competent to issue a warrant of arrest for the production of aperson before his own court.

Themagistrate is not competent to issue a warrant of arrest for the production ofa person before a police official.

Held: In terms of s.64-A (1)(a), it is the liability of the customer to pay the extra price when the excise duty had been enhanced prior tothe delivery of the vehicle
On facts, no evidenceto show that there was any deliberate intention on the part of the manufacturerand the dealer to delay the delivery of the vehicle
Thus, the order passedby the National Commission that the increase in price by way of additionaltaxes is to be borne by the customer and not by the manufacturer, upheld by Supreme Court.

Facts and Circumstances of the Case:-

That the appellant and respondent no. 2 got married on 23.9.1998 atJalandhar as per Sikh rites and from the said wedlock a son, namely, GurarjitSingh was born on 5.10.1999. The partiesto the marriage could not pull on well together because of temperamental differences and decided to get divorce and, therefore,filed HMA Case No. 168 of 19.9.2007 before the District Judge, Ludhiana under Section 13-B of Hindu Marriage Act, 1955 (hereinafter called the`Act 1955') for dissolution of marriage by mutual consent. In the said case, statements ofappellant and respondent no. 2 were recorded on 19.9.2007 and proceedings wereadjourned for a period of more than six months to enable them to ponder over the issue.
The parties again appeared before the court on 20.3.2008 on second motion andtheir statements were recorded and bothof them affirmed that it was not possible for them to live together and, therefore, the learned District Judge, Ludhiana vide judgment and order dated 20.3.2008 allowed the said petition and dissolved their marriage.
Respondent no. 2 fileda complaint before Senior Superintendent of Police, Ludhiana against the appellant on 4.5.2009 under the provisions of the Act 2005 alleging thatthe decree of divorce obtained by them was a sham transaction. Even after getting divorce, both of them hadbeen living together as husband and wife. She was forced to leave the matrimonial home. Thus, she prayed for justice. The said complaint was sent to SP, City-I, Ludhiana for conducting inquiry.
The said SP, City-Iconducted the full-fledged inquiry and submitted the report on 4.5.2009 to the effect that the parties had been living separately after divorce and, no case was made out against the present appellant.However, he suggested to seek legalopinion in the matter.
Accordingly, legalopinion dated 2.6.2009 was sought, wherein it was opined that the parties had obtained the divorce decree by mutual consent and the allegations madeby respondent no. 2 against the appellant were false and baseless and the purpose of filing the complaint was only to harass the appellant.
Respondent no. 2subsequently filed a complaint under theAct 2005 on 12.6.2009. The learned Magistrate issued the summons to the appellant on the same date. The Magistrate vide order dated 3.10.2009 summoned the minor child for counseling. The appellant, being aggrieved of the order ofLd. Magistrate dated 12.6.2009, filed application dated 13.10.2009 underSection 482 Cr.P.C. for quashing the complaint dated 12.6.2009.
In the meanwhile, respondent no. 2 filed Civil Suit on 17.7.2009 in the court of Civil Judge (Senior Division), Ludhiana, seekingdeclaration that the judgment and decree dated 20.3.2008, i.e. decree ofdivorce, was null and void as it had been obtained by fraud. The said suit isstill pending.
Respondent no. 2 alsofiled application dated 17.12.2009 under Guardians and Wards Act, 1890 forgrant of custody and guardianship of the minor child Gurarjit Singh and the same is pending for consideration before the Additional Civil Judge (Senior Division), Ludhiana.
Respondent no. 2 on 11.2.2010 also lodged an FIR under Sections 406, 498-A, 376, 120-B of the Indian Penal Code, 1860 (hereinafter called `IPC') against the appellant and his mother and sister.
Inthe instant case, the parties got married and the decree of Civil Court fordivorce still subsists. More so, a suitto declare the said judgment and decree as a nullity is still pendingconsideration before the competent court.
In view of the provisions of Section 468 Cr.P.C., that the complaint could be filed only within aperiod of one year from the date of theincident seem to be preponderous in viewof the provisions of Sections 28 and 32 of the Act 2005 read with Rule 15(6) of The Protection of Women from Domestic Violence Rules, 2006 which make the provisions of Cr.P.C. applicable and stand fortified by the judgments of this court in Japani Sahoo v. Chandra Sekhar Mohanty, AIR 2007 SC 2762; and Noida Entrepreneurs Association v. Noida & Ors., (2011) 6 SCC 508.
In view of the above, we are of the considered opinion that permitting the Magistrate to proceed further with the complaintunder the provisions of the Act 2005 is not compatible and in consonance with the decree of divorce which still subsists and thus, the process amounts to abuse of the process of the court. Undoubtedly, for quashing acomplaint, the court has to take its contents on its face value and in case thesame discloses an offence, the court generally does not interfere with thesame. However, in the backdrop of thefactual matrix of this case, permitting the court to proceed with the complaintwould be travesty of justice. Thus, interest of justice warrants quashing ofthe same.
Theappeal succeeds and is allowed. The impugned judgment and order dated 9.8.2010is hereby set aside. Petition filed by the appellant under Section 482 Cr.P.C. is allowed. Complaint No. 87/02/09 pending before the Magistrate, Jalandhar and all orders passedtherein are quashed.

Insurer can recover compensation amount from the insured owner of the vehicle in spite of excess of permitted number of passenger

Persons travelling in the vehicle in excess of the permitted number of six passengers, though entitled to be compensated by the owner of the vehicle, would still be entitled to receive the compensation amount from the insurer, who could recover it from the insured owner of the vehicle—Supreme Court of India

Motor Vehicles Act, 1988 – sections 147 and 149 – Motor accident – Compensation – Liability of insurer –
Insurance policy taken by the owner of the vehicle covering six passengers including the driver
Vehicle while driven by father of the owner, met with an accident
Passengers in excess of the number covered by the insurance policy, travelling in the vehicle at the time of accident
Death/injury to the passengers
Claim petitions – Liability of the insurer
Held: Is confined to the number of persons covered by the insurance policy only and liability to pay the other passengers is that of the owner of the vehicle
Persons travelling in the vehicle in excess of the permitted number of six passengers, though entitled to be compensated by the owner of the vehicle, would still be entitled to receive the compensation amount from the insurer, who could recover it from the insured owner of the vehicle
There can be no pick and choose method to identify the five passengers, excluding the driver, in respect of whom compensation would be payable by the Insurance Company
In the interest of justice, Insurance Company directed to deposit the total amount of compensation awarded to the claimants which would be disbursed to the claimants
Insurance Company would be entitled to recover the amounts paid by it, in excess of its liability, from the owner of the vehicle, by putting the decree into execution.

Legal Alert:::District Forum and State Commission Have not been Given Any Power to Set Aside Ex parte Orders and Power of Review--Supreme Court

The main question which arises for consideration is whether the District Consumer Forums and the State Commissions have the power to set aside their own ex parte orders or in other words have the power to recall or review their own orders? The questions of law involved in both the appeals are identical, therefore, the Hon’ble Supreme Court deem it appropriate to dispose of both these appeals by a common judgment.

Brief facts necessary to dispose of these appeals are recapitulated as under:

First Appeal:-

Smita Achyut Karekar was admitted to Ashirwad Nursing Home as she was suffering from the ailment of slip disc. The operation was performed on 8.10.1997. It was noticed, at about 3.45 pm on that day, that her blood vessels had ruptured accidentally during the surgery. She was declared dead at 5.35 pm.

The complainants issued a legal notice on 24.7.1999. Reply to the legal notice was sent on 7.8.1999. The complainants filed complaint alleging deficiency in service and claimed compensation of Rs.15,00,000/-. The complainants did not take necessary steps to remove objection and to complete procedure under the Consumer Protection Act, 1986. The State Commission, Maharashtra issued notice to the opposite parties/appellants herein on 10.02.2004. On 9.9.2004, the State Commission dismissed the complaint for want of prosecution. On 04.11.2004, the complainants filed an application for recalling 9.9.2004 order and consequently the State Commission recalled the order dated 9.9.2004 and restored the complaint. The appellants aggrieved by the said order preferred a Revision Petition No.551 of 2005 before the National Consumer Disputes Redressal Commission, New Delhi. The appellants in the revision petition made two main arguments before the Commission : firstly, that the State Commission did not have the power to restore the complaint and, secondly, that the State Commission restored the complaint without issuing notice to the appellants. The National Commission dismissed the revision petition which has been challenged by the appellants before this Court.

Second Appeal

The National Commission passed an ex parte order and in the appeal against the order, this Court gave liberty to the appellants to approach the Commission for setting aside the ex parte order. Thereafter, an application was filed by the complainants for review of the order. The Commission vide order dated 12.7.2001 (relied on the judgment of Jyotsana’s case) 17dismissed the application. Aggrieved by the said order, the appellant has filed this appeal.

On careful analysis of the provisions of the Act, it is abundantly clear that the Tribunals are creatures of the Statute and derive their power from the express provisions of the Statute. The District Forums and the State Commissions have not been given any power to set aside ex parte orders and power of review and the powers which have not been expressly given by the Statute cannot be exercised.

Legal Alert::Whether foreign airliner amenable to the jurisdiction of national Commission – Held Yes by Supreme Court

No n d e l i v e r y o f consignment by foreign airliner – Complaint entertained by National Commission and compensation granted – Whether foreign airliner amenable to the jurisdiction of national Commission – Held,Yes by Supreme Court

The appellant is an International Cargo carrier, with its principal place of business at Beirut, Lebanon. Respondent No.1 is a garment exporter and respondent No.2 is an accredited International Air Transport Association agent. The agent made out three airway bills for shipping of garments to Spain on behalf of the consignor through the appellant-carrier .In the consignee column, the consignment was addressed as: The airway bills from Bombay to Amsterdam were dated 25- 08-1992 and the consignment through the appellant-carrier reached Amsterdam on 30-08-1992. From Amsterdam, the consignments were sent to Madrid by road on the following day, and they reached Madrid on 03-09-1992 and were cleared by the Customs Authorities. The appellant-carrier delivered the consignment to M/s Liwe Espanola, as according to them, that was the only recognizable address available from the documents furnished by the consignor.

After nine months from the date of shipment, the agent made enquiry regarding two of the three airway bills. Since there was no response, the agent made further enquiry again after four months. In response to the query, the appellant-carrier informed the consigner that on finding the full name and complete postal address of the consignee as M/s Liwe Espanola, the appellantcarrier has delivered the goods to it. It was at this stage, the consignor claimed that the consignee of the said consignment was Barclays Bank, Madrid, which had only one branch in Madrid and since the appellant carrier had wrongly delivered the consignment to the address mentioned in the Block column instead of routing it through Barclays Bank and, therefore, there is deficiency of service. Accordingly, the consignor instituted a complaint under Section 12 of the CP Act before the National Commission, inter alia, claiming compensation for the alleged deficiency of service by the appellant-carrier and the agent for not delivering the said consignment to the consignee. The National Commission, after considering the entire evidence on record, has come to the conclusion that the services rendered by the appellant-carrier was deficient and thereby, it was liable to pay compensation equivalent to US $71,615.75 with 5% interest from the date of the Complaint till its realization, and imposed costs of Rs.1 lakh. It is the correctness or otherwise of this order, which is called in question in this appeal.

The Hon’ble Supreme Court has dismissed the appeal of appellant and held that National Commission has jurisdiction to decide the dispute between the parties and it is a Court and that there was deficiency in service by the appellant-carrier.

Reason:- In our view, the protection provided under the CP Act to consumers is in addition to the remedies available under any other Statute. It does not extinguish the remedies under another Statute but provides an additional or alternative remedy. In the instant case, at the relevant point of time, the value of the subject matter was more than Rs.20 lakhs, by which the National Commission is conferred jurisdiction for any cause of action that arises under the Act. In the present case, as we have already noticed that the consignor had furnished all the relevant information in the airway bill which would satisfy the requirements of both Rule 6 and 16 of the rules and, therefore, the consignor cannot be accused of not furnishing the correct particulars and information in the airway bill which is handed over to the appellant-carrier with the cargo. In our view, the appellant carrier cannot absolve its responsibilities by contending that it would be practically impossible to verify the correctness of all the airway bills which are furnished with the cargo. The appellant’s contention that the name and address of the consignee was inadequate is difficult to accept. There is evidence on record to show that documents supporting the letter of credit were sent by the consignors using the selfsame name and address and there was no difficulty in the same being delivered to the consignee bank. We are in total agreement with the conclusion reached by the National Commission. Therefore, we do not see any merit in the contention canvassed by the learned counsel for the appellant-carrier. We conclude that the National Commission has jurisdiction to decide the dispute between the parties and it is a Court and that there was deficiency in service by the appellant-carrier.

The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 passed by parliament in December 2007, has been brought in to force by all seven UTs and following 23 states

SALIENT FEATURES OF THE ACT

Definitions

“Senior Citizen” is any citizen of India aged 60+, whether living in India or not.

“Parent” is a father or mother, even if below 60 years in age.

“Children” include adult son, daughter, grandson and granddaughter.

Whether , Senior Citizen / parent/ grand parent, who is unable to maintain himself from his own income, can claim maintenance from his children.
A childless Senior Citizen can claim maintenance from his relative who is in possession of , or would inherit the senior citizen’s property.
Obligation of the children/relative with sufficient means is to meet the needs of the parents/senior citizen so that they can lead a normal life.
State Governments have constituted /are constituting Maintenance Tribunal at Sub Divisional Level. Senior Citizen may submit application for maintenance to this tribunal.
If Senior Citizen is incapable of making a application himself, any other person or registered voluntary organisation authorized by him can file it on his behalf.
Maintenance Tribunal can award up to Rs. 10,000 per month as maintenance allowance payable to the senior citizen by his child/relative. They have to decide the application for maintenance within ninety days.
Transfer of property by senior citizen in favour of a child/relative, done after commencement of the act can be declared void by the Tribunal in case of negligence by child/relative looking after the senior citizen.
Appeal against an order of Maintenance Tribunal can be the filed with the District Level Appellate Tribunal.
Legal practioners cannot represent parities before Maintenance & Appellate Tribunals.
State Governments are also to designate the Distt. Social Welfare Officer or an equivalent officer as Maintenance Officer, who can then represent a parent, on request, before a Maintenance or Appellate Tribunal.
Abandonment of a Senior citizen is punishable with imprisonment up to 3 months, or fine up to Rs. 5000/-, or both.

Plea Bargaining came in the amendment Act of 2005 in Code of Criminal Procedure, there are not much cases regarding it but even though, position under Indian Judiciary is very clear.

Section 265-A to 265-L provides for the plea-bargaining under Code of Criminal Procedure. It is a devise which ensures that victims receive acceptable justice in reasonable time without risking the prospects of hostile witness, inordinate delay and non- affordable costs.Plea-bargaining is the process whereby the accused and the prosecutor in a criminal case work out a mutually satisfactory disposition of the case subject to the court approval. It usually involves the defendant’s pleading guilty to lesser offence as to only one or some of the courts of a multi-count indictment in return for a lighter sentence than that possible for the graver charge. Therefore, it can be said that plea-bargaining refers to pre-trial negotiations between the defendant through his/her counsel and the prosecution during which the accused agrees to plead guilty in exchange for lesser punishment.

It is applicable only in respect of those offences for which punishment of imprisonment is up to a period of 7 years.
It does not apply where such offence affects the socio- economic condition of the country or has been committed against a woman or a child below the age of 14 years.
The application should be filed by the accused voluntarily.
An accused must file an application for Plea-bargaining in the court in which such offence is pending for trial
The accused and prosecution both are given time to work out a mutually satisfactory disposition of the case, which may include giving compensation to the victim by the accused and other legal expenses incurred during pendency of the case.
Where a satisfactory disposition of the case has been worked out, the Court shall dispose of the case by sentencing the accused to one-fourth of the punishment provided or extendable, as the case may be for such offence.
The statement or facts stated by an accused in an application for plea-bargaining shall not be used for any other purpose other than for plea-bargaining.
The judgment delivered by the Court in the case of plea-bargaining shall be final and no appeal shall lie in any court against such judgment.

This principle is not applicable for hard crimes or serious crimes, therefore, Indian Law does not provides plea-bargaining for the offences in which (a) offence in punishable with death or imprisonment for life; (b) punishable with imprisonment for a term exceeding 7 years; (c) committed against socio economic conditions of the country; (d) offence committed against women and children below the age of 14 years.

Who is Stock Witness???

A Stock Witness is a person who is at the back and call of the police. He obliges police with this tailored testimony. Such a witness is used by the police in raid cases. Such witness are highly disfavoured by the judges.

Once it is proved that a certain witness examined by the prosecution is a stock witness of the police, the court would be justified in discarding his testimony. But that in itself is not enough to falsify the entire prosecution case. In such a case, it is the duty of the court to brush aside the testimony of the stock witness and to see if the remaining prosecution evidence is enough to sustain the conviction of the accused.

A registered society is viewed as an independent juridical ‘person’. It is different from the people who form it. The registered society can

1. Purchase the property.

2. File cases.

3. It can get exemption from income tax.

4. It has limited liability.

5. Any property held can pass from one generation to another without having to pay any transfer fees or taxes and without any cumbersome documentation.

6. The properties of a an incorporated body can be easily protected from rival claimants and resulting litigants.

Property which is vested in the members of an unregistered society becomes “ property belonging to the society” after registration and , and there is no transfer of ownership.

A society registered in India and having all of its members as foreigners is still an ‘Indian’ society and governed by Indian Laws. Conversely when registered outside and all members are Indian then society is a foreign society.

A unregistered society is not recognised as an independent juridical person under law. Therefore, it does not enjoy the benefits mentioned above. Failure to register the institution gives it no legal face and only the trustees in charge of the fund have a legal status. A promissory note executed in favour of the institution in this event is void and no suit can be instituted to enforce it on behalf of the institution.

Legal Tip of the Day:TEN POINTS FOR DRAFTING A FOOLPROOF AGREEMENT

According to Indian Contract Act, “When one person signifies to another his willingness to do or to abstain from doing anything, with a view to obtaining the assent of that other to such act or abstinence, he is said to make a proposal. When the person to whom the proposal is made signifies his assent thereto, the proposal is said to be accepted. A proposal, when accepted, becomes a promise.”

Every promise and every set of promises, forming the consideration for each other, is an agreement. An agreement enforceable by law is a contract.

The following guidelines will help in the drafting of a fool-proof agreement:-

The language of the agreement should be simple, free from ambiguities and vagueness.
The subject matter should be divided into paragraphs and the sequence must be maintained.
The agreement must cover all the points agreed upon by both the parties and give equal coverage of both the sides.
There must be a clause indicating the obligations of the agreement on both the parties.
There must be a clause stipulating the duration of the agreement as well as clause regarding its administration. Recognized principle is that an agreement remains operative until it is replaced by new modified terms.
Figures with regard to dates and amounts etc. are generally written in words or both.
The name of the place where the document is executed should be specified. Similarly, the date of the deed should be written in words.
The names and description such as parentage, occupation, residential and permanent address of the parties, if necessary to the deed, should be given.
For the purpose of brevity of writing and for long description of parties, their abbreviations are coined e.q. A.B. ( hereinafter referred as “employer”).
After necessary clauses, will follow the signature of the respective parties to be witnessed by one or more witnesses and attested by them with date and place of execution.

Dissolution of the Partnership Firm by Court

The Court may dissolve a partnership firm at the suit of a partner on any of the following grounds:-

1. that a partner has become of unsound mind, in which case the suit may be brought as well by the next friend of the partner who has become of unsound mind as by any other partner;

2. that a partner, other than the partner suing, has become in any way permanently incapable of performing his duties as partner;

3. that a partner, other than the partner suing, is guilty of conduct which is likely to affect prejudicially the carrying on of the business regard being had to the nature of the business;

4. that a partner, other than the partner suing, willfully or persistently commits breach of agreements relating to the management of the affairs of the firm of the conduct of its business; or otherwise so conducts himself in matters relating to the business that it is not reasonably practicable for the other partners to carry on the business in partnership with him;

5. that a partner, other than the partner suing, has in any way transferred the whole of his interest in the firm to a third party, or has allowed his share to be charged under the provisions of rule 49 of Order XXI of the First Schedule to the Code of Civil Procedure, 1908, or has allowed it to be sold in the recovery of arrears of land revenue or of any dues recoverable as arrears of land revenue due by the partner;

6. that the business of the firm cannot be carried on save at a loss; or

7. on any other ground which renders it just and equitable that the firm should be dissolved.

Legal Knowledge::An Acknowledgement

An acknowledgment is an admission of debt, made in writing and signed by a person regarding his liability, made to the creditor or to some other person on his behalf. The acknowledgment is used for supplying evidence of debt or to extend the period of limitation. There is no specific form for acknowledgment and it may be in any form, so far it expresses the acknowledgment of liability of a debt. The words used in the acknowledgment should indicate the existence of relationship of debtor and creditor and it should be clear that the statement has been made with the intention to admit such relationship. The intention to admit relationship either should be expressly in words or it may be inferred from the words used.

The essential requirements of an acknowledgment are as under:
(1) Acknowledgment should be relating to subsisting liability-The acknowledgment should be relating to subsisting liability. It does not create a new right. The words used in acknowledgment should clearly indicate the relationship of creditor and debtor and the intention to admit such relationship. The intention to admit relationship should either be in express words or can be inferred by implication.
(2)Acknowledgment must be made before the limitation period-The acknowledgment must be made before the limitation period as acknowledgment of time barred debt cannot save limitation. However, a person may execute a fresh bond to pay the time barred debt. An acknowledgment does not imply that the debt was not time barred. The plaintiff has to prove that the acknowledgment was made before the expiry of limitation period.
(3) An acknowledgment should be made by the person liable to pay or an agent duly authorised in this behalf-An acknowledgment should be made by the person against whom such right is claimed or by an agent duly authorised in this behalf. Acknowledgment can be made on behalf of a person under disability, by his lawful guardian, committee or manager or an agent duly authorised by such guardian, committee or manager to sign the acknowledgment. A partner can acknowledge debt on behalf of the firm and an acknowledgment given by him will be good against other partners of the firm. A karta of the Hindu undivided family can acknowledge on behalf of the family and an acknowledgment by the duly authorised agent of the manager of the family, shall be good acknowledgment on behalf of the whole family.
(4) Acknowledgment of liability must be in writing, signed by the party against whom such right is claimed or by his duly authorised agent in this behalf-The acknowledgment of liability must be in writing signed personally by the party against whom such right is claimed or by his duly authorised agent in this behalf.
To constitute acknowledgment of liability, there must be acknowledgment of liability made in writing signed by the party and that too must be before the expiry of the prescribed period and if there is acknowledgment of liability signed by the party against whom such property or right is claimed, a fresh period of limitation starts from the time of acknowledgment of liability.

Special Legal Tip on the occasion of Mother’s Day ::8th of May 2011

When ravinder’s parents registered their house in ravinder’s name. He left his parents after registration of the property in his name. His old parents were helpless. They had no source of income to live. At that movement law had come to rescue their life.
To ensure proper maintenance of parents and senior citizens, the Government of India created a new Act titled: The Maintenance and Welfare of Parents and Senior Citizens Act of 2007. Under this Act, children and property hirers must take care of the maintenance of their parents/senior citizens. The purpose of enacting this Act was to fulfill the gaps in the Section 125 of Code of Criminal Procedure, 1973.
Under the Section 125 of Code of Criminal Procedure,1973
• Proceedings are not time bound.
• It is limited to provision for maintenance of parents and is also silent on welfare measures.
• It has provisions for maintenance of parents only and not of Senior Citizens. This implies that childless people may not get refuge in Code of Criminal Procedure even if they have heirs to their property.
• This Act caters only to distressed parents.
Maintenance and Welfare of Parents and Senior Citizens Act, 2007
It has been enacted to provide for more effective provisions for the maintenance and welfare of parents and senior citizens guaranteed and recognized under the Constitution.
• Section 5(4) of this Act specifically states that the issue has to be concluded by the Tribunal in not more than 90 days staring from the date of the service of notice of the application.
• It has provisions for maintenance and look after the welfare of parents and senior citizens. It is a comprehensive Act and has a broader scope and is not limited to the sphere of parent-child relationship. The Act holds the State responsible for the implementation of welfare measures for senior citizens.
• Section 4(1) of this Act specifies that senior citizens have the right to ask for maintenance expenses from legal heirs of their property.
• Section 5(1) of this Act stipulates that any parent or senior citizen can file for maintenance. The Tribunal may also initiate the case suo motu.
Section 125 of the Code of Criminal Procedure provides that lawyers/advocates can act on behalf of their clients. However, Section 17 of Maintenance and Welfare of Parents and Senior Citizens Act specifically states that a legal practitioner cannot act on behalf of a party to a proceeding in the Tribunal.

जयपुर गोल्डन अस्पताल पर ठोका 1.50 करोड़ का दावा

रोहतक के कारोबारी मुलकराज धमीजा ने अपने किडनी ट्रांसप्लांट के इलाज मे लापरवाही का आरोप लगाते हुए जयपुर गोल्डन अस्पताल पर 1.50 करोड़ रुपये का हर्जाना दिलाने का दावा करते हुए नैशनल कंस्यूमर डिस्प्यूट रिड्रेसल कमिशन में याचिका दायर की है। कमिशन ने धमीजा की इस याचिका पर मामले की जांच एम्स, नई दिल्ली के 3 डॉक्टरों के पैनल को सौंप दी है। इस पैनल को अपनी जांच रिपोर्ट 8 सप्ताह के भीतर सौंपने के लिए कहा गया है।

उल्लेखनीय है कि मुलकराज ने 26 दिसंबर, 2006 को जयपुर गोल्डन अस्पताल में किडनी डलवाई थी। किडनी ने ठीक से काम नहीं किया और मुलकराज परेशान होते चले गए। मुलकराज का आरोप है कि डॉक्टरों ने किडनी डालने में लापरवाही बरती, जिस कारण वह और अधिक बीमार हो गए। बार-बार शिकायत करने के बाद भी डॉक्टरों ने उसे गंभीरता से नहीं लिया। इस दौरान अस्पताल में उसके करीब 5 लाख रुपये खर्च भी हो गए।

उन्होंने डॉक्टरों की लापरवाही की शिकायत मेडिकल काउंसिल से की थी, जिस पर एमसीआई ने संबंधित डॉक्टरों के लाइसेंस 1 माह के लिए सस्पेंड कर दिए थे। धमीजा ने अब अपनी शिकायत कमिशन से की है। कमिशन में धमीजा के केस की पैरवी कर रहे वकील नीरज दत्त ने बताया कि जयपुर गोल्डन के पास नियमित नेफ्रोलोजिस्ट न होने से किडनी ट्रांसफर का लाइसेंस भी नहीं था, बावजूद उसके ऑपरेशन कर दिया गया।

युवती रह सकती है अपनी सहेली के साथः हाईकोर्ट

छत्तीसगढ़ उच्च न्यायालय ने एक महत्वपूर्ण फैसले में युवती को उसकी हमउम्र सहेली के साथ रहने की अनुमति दे दी है। अदालत ने कहा है कि बालिग होने के कारण युवती जहां चाहे वहां अपनी मर्जी से रहने के लिए आजाद है।

मिली जानकारी के मुताबिक रायपुर निवासी नेहा सिंघानिया की गोंदिया की खुशबू जायसवाल से बचपन से दोस्ती थी। बाद में नेहा के पिता के रायपुर में बस जाने पर भी दोनों सहेलियां के जरिए संपर्क में थीं। नेहा रायपुर में कोरियोग्राफर का कोर्स भी कर रही थी। अचानक कुछ माह पूर्व खुशबू ने उसको पत्र लिखकर बताया कि उसे उसके माता-पिता लगभग कैद कर रखे हुए है और वह अब अपने माता-पिता के साथ नहीं बल्कि उसके साथ रहना चाहती है।

पत्र मिलते ही नेहा ने उच्च न्यायालय में बंदी प्रत्यक्षीकरण याचिका प्रस्तुत की। सुनवाई के बाद अदालत ने मार्च 2011 में खुशबू के माता-पिता और रायपुर व गोंदिया के पुलिस अधीक्षक को नोटिस जारी किया। नोटिस के बाद भी न तो जवाब प्रस्तुत हुआ और न ही युवती को हाजिर किया गया।

बाद में प्रशानिक दबाव पड़ने पर खुशबू के माता-पिता अदालत में पेश हुए। पुलिस ने खुशबू को भी न्यायालय में पेश किया। जस्टिस धीरेन्द्र मिश्रा और जस्टिस रंगनाथ चंदाकर की युगल पीठ ने फैसला सुनाते हुए कहा कि युवती बालिग है। इसलिए वह जहां चाहे वहां अपनी मर्जी से रहने के लिए आजाद है।

It was alleged that the petitioner appeared in the examination LLB II Year as an ex-student as per old syllabus but he was made to answer one of the papers in Criminal Law as per new syllabus by the opposite parties. State Commission was of the view that University does not render any service for consideration in the matter of conducting examination/evaluating the papers and declaring the results and petitioner was, thus, not a consumer. Where there was advertisement regarding ‘voltage fuluctions no problem’ as T.V. as having inbuilt stabilizer. But the said T.V. had burnt due to voltage fluctuations. Repair and replacement after warranty period refused. Warranty could not effect the statutory right of seeking relief against defective goods. Truth of advertisement must be proved. As in built stabilizer safeguards against limited voltage fluctuation, were not advertised, hence, unfair trade practices had been proved. पुलिस ने सेंधमारी में शामिल एक ऐसे विदेशी गैंग का पर्दाफाश किया है, जिसने दिल्ली के पॉश इलाकों को टारगेट बनाने से पहले भारत के कानूनों की बाकायदा स्टडी की। गैंग के एक मेंबर एडियर जैडिबर (31) को गिरफ्तार किया गया है। उसने पुलिस को बताया है कि भारत आने से पहले उनके गैंग ने इंडियन पीनल कोड की स्टडी की थी। ये लोग इस नतीजे पर पहुंचे थे कि भारत में सेंधमारी के बारे में कानून बहुत कमजोर है। पकड़े जाने पर बच निकलना आसान होगा। साथ ही इन वारदातों से अच्छा-खासा माल भी हाथ लग सकता है।

एडियर के अलावा इस गैंग के बाकी मेंबर एडिसन मौरियलो, कार्लोस अल्फांसो और मोनिका यूलिएट्च हैं। ये सभी लैटिन अमेरिकी देश कोलंबिया से हैं। एडियर कोलंबिया की राजधानी बगोटा का है। चार लोगों के इस गैंग के बाकी तीन लोग फरार हैं।

पुलिस के मुताबिक, इस गैंग ने इंडियन पीनल कोड की स्टडी करने के बाद ग्रुप बनाकर भारत के लिए तीन महीने का टूरिस्ट वीजा लिया। भारत आकर इन्होंने वालमार्ट से ताले तोड़ने के औजार खरीदे और साकेत में सेंधमारी की दो वारदात कीं। गिरफ्तार एडियर से डेढ़ लाख रुपये कैश, 15 लाख की जूलरी और औजार बरामद किए गए हैं।

पहली सेंधमारी की वारदात 13 मार्च को साकेत के 'जे' ब्लॉक में सीनियर सिटिजन हिना दास के घर पर हुई। पुलिस को आसपास के लोगों ने बताया कि विदेशी चेहरे-मोहरे की एक लड़की को उन्होंने वारदात से पहले इलाके में संदिग्ध हालत में घूमते देखा था। इस गैंग ने 15 मार्च को साकेत के 'जी' ब्लॉक में नरेंद्र मोहन शर्मा के घर का ताला तोड़कर चोरी की। यहां भी पुलिस को विदेशी लड़की और उसके साथी देखे जाने की बात पता लगी। डीसीपी (साउथ) हरगोविंद धालीवाल के मुताबिक, इसके बाद साकेत के एसएचओ राजेंद्र सिंह की टीम ने छानबीन शुरू की और उनके हाथ संदिग्ध हालत में घूम रहा एडियर लग गया।

अपशब्दों का इस्तेमाल अपराध नहीं: हाई कोर्ट

दिल्ली हाई कोर्ट के अनुसार जवानों के बीच अपने साथियों के साथ बातचीत के दौरान गालियों व अपशब्दों का इस्तेमाल आम बात है। इसके साथ ही अदालत ने सीआईएसएफ के एक जवान को सेवा में बहाल करने का आदेश दे दिया, जिसे अपने वरिष्ठ साथी के साथ अपशब्दों के इस्तेमाल के आरोप में सेवामुक्त कर दिया गया था।

जज प्रदीप नंदराजोग और जज सुरेश कैट की खण्डपीठ ने केंद्रीय औद्योगिक सुरक्षा बल (सीआईएसएफ) इकाई आईओसी, पानीपत से बर्खास्त किए गए एक सिपाही कृष्ण पाल सिंह की याचिका पर यह फैसला सुनाया।

खण्डपीठ ने बुधवार को अपने फैसले में कहा, ' जीवन के अनुभव, कानून के तर्क से ज्यादा प्रामाणिक होते हैं। हमारा अनुभव हमें बताता है कि जवान आपस में बातचीत करते समय सड़क छाप भाषा का इस्तेमाल करते हैं और मुक्त रूप से गालियों के साथ सवाल करते हैं। '

अदालत का यह आदेश 16 दिसम्बर, 2002 को घटी उस घटना से सम्बंधित है, जिसमें कृष्ण पाल सिंह की एक उप निरीक्षक (एसआई) आर.एल. पंडित के साथ तकरार हो गई थी। पंडित सीआईएसएफ इकाई आईओसी, पानीपत के शिफ्ट प्रभारी थे।

सिंह ने आरोप लगाया था कि पंडित ने झगड़ा शुरू किया और उन्हें थप्पड़ मारा, जबकि पंडित का आरोप था कि सिंह ने उन्हें गाली दी और उन पर हमला किया। घटना की प्रारम्भिक जांच के बाद सिंह को 17 दिसम्बर, 2002 को तत्काल प्रभाव से निलम्बित कर दिया गया था।

सिंह ने जांच समिति को 16 दिसम्बर, 2002 को बताया था कि उनकी तबीयत ठीक नहीं थी और जब उनकी ड्यूटी रात नौ बजे समाप्त हो गई और उनकी जगह दूसरा जवान नहीं पहुंचा तो उन्होंने पंडित से फोन पर सम्पर्क किया और जानना चाहा कि उन्हें ड्यूटी से छुड़ाने के लिए दूसरा जवान क्यों नहीं पहुंचा।

याचिका के अनुसार, ' पंडित ने सिंह से कहा था कि उन्होंने हेड कांस्टेबल देवेंद्र कुमार से अनुरोध किया है कि जब तक दूसरा कोई ड्यूटी पर नहीं पहुंच जाता है, तब तक वह सिंह की चौकी की निगरानी करें। '

सिंह ने आरोप लगाया कि पंडित के कहे अनुसार, कुमार के पहुंचने के बाद वह ड्यूटी स्थल से चले गए और वहां से गेट संख्या एक पर गए, जहां पंडित ने उन्हें मां की गाली दी। जांच के बाद सिंह को पूर्ण पेंशन लाभों के साथ अनिवार्य सेवानिवृत्ति का दंड दे दिया गया।

दिल्ली हाई कोर्ट ने अपने फैसले में कहा है, ' जो तथ्य हमारे सामने आए हैं, और जिनके कारण लड़ाई शुरू हुई, उसके अनुसार इस सम्भावित सच्चाई की ज्यादा सम्भावना है कि जब याचिकाकर्ता गेट संख्या एक पर पहुंचा तो एसआई आर.एल. पंडित ने सहज मस्ती में अपशब्दों का इस्तेमाल किया। '

पीठ ने कहा, ' तबीयत ठीक न होने के कारण याचिकाकर्ता का मन अच्छा नहीं था और वह इस तरह की भाषा बर्दाश्त नहीं कर सका। इसके कारण विवाद शुरू हो गया और उसके बाद हाथापाई हुई। '

पीठ ने कहा, ' हमने पाया कि इस मामले में परिस्थिति एवं तथ्यों को ध्यान में रखते हुए न तो अनुशासनात्मक प्राधिकरण ने विश्लेषण किया, न तो अपीली प्राधिकरण ने और न पुनरीक्षण प्राधिकरण ने ही। उप निरीक्षक ने झूठी गवाही दी थी। '

अदालत ने जांच अधिकारी की राय को खारिज कर दिया और आदेश दिया कि सिंह को तत्काल सेवा में बहाल किया जाए और 10 मार्च से पूर्ण वेतन दिया जाए।

Legal Knowledge::DISMISSAL OF A FEMALE EMPLOYEE FOR SLAPPING A SECURITY GUARD IS LIABLE TO BE QUASHED WHEN SHE WAS SEXUALLY HARASSED BY HIM

The petitioners(woman) was employed with the respondents ( HMT Limited) in their watch marketing division.
She was being sexually harassed by the security guard twice.
Each time, she filed a complaint against the guard before the authority of the company. But the authority of the company did not take any action with regard to her complaint.
Later the same security guard sexually harassed her by way of comments and she slapped the guard with her slipper.
A complaint was filed against her by the security guard before the authority of the Company.
The Company appointed an inquiry officer to inquire into the allegations made by the security guard and on the basis of the findings of the enquiry report, the Company imposed upon her a penalty of removal from service.
The woman challenged the order of removal by way of a writ petition before the High Court of Madhya Pradesh.
The Court held, “The question with reference to punishment would also be relevant in the light of the findings arrived at by the inquiry officer. It is not a case that the petitioner after receiving the charge-sheet has made any complaint against the attitude and misbehavior of Shri Gulab Singh(Security Guard) but it is a case where prior to the incident there were two complaints against the complainant but the management did not take any action against him. On the date of incident also the petitioner was sexually harassed by way of comment on her by the complainant there it could be understandable that the petitioner being a lady was left with no option but to take some action in her defence. The reliance can profitably had to the decision of the Apex Court observed in Vishaka and others vs State of Rajasthan and others, AIR 1997 SC 3011. Their Lordships of the Apex Court have held that sexual harassment of working woman amounts to violation of rights of gender equality and right to life and liberty. Applying the ratio laid down by the Apex Court, the present is not a case where the behavior and attitude of the petitioner of slapping by chappal and abusing complaint Shri. Gulab Singh was irritating in any manner. Since the petitioner was sexually harassed in the past and complaints were made by her but no action was taken thereupon and on the date of incident also the sexual harassment was practiced on the petitioner, therefore, it cannot be said that the petitioner was unjustified in defending herself against the sexual harassment. These aspects have not been taken into account by the disciplinary authority as well as by the appellate authority, therefore, the impugned orders are unsustainable in the eyes of law.”
The Court directed the respondents( Company) to reinstate the petitioner in service with 75% back wages.

Recording proceedings favoured by judge

A Delhi high court judge has strongly backed “authenticated audio-video recording” of court proceedings.
A day before his retirement, Justice S N Dhingra, while deciding a petition seeking permission to record court proceedings on Monday, observed that this will “help in smooth functioning of district courts” and also discipline not only judges who don’t come to court but also advocates and litigants who try to obtain orders by show of force or threats to the court”.
At present, any attempt to record court proceedings is tantamount to contempt of court and attracts punishment. HC was hearing a plea by one Deepak Khosla through his lawyer K V Dhananjai seeking permission to record proceedings in cases where he is a party. Justice Dhingra referred the matter to a larger HC bench, saying the matter concerned not just one court but all Delhi courts and therefore ought to be considered by a larger bench.
The judge said recording would help in cases in appeal stage where one party claims certain incident never happened in trial court stage. He warned any audio-video recording ought to be properly “authenticated” because “technology of fabricating recordings is advanced” and pointed to the inherent danger the recording, if done by a dishonest litigant/lawyer, poses to the courts. “Therefore any recording sought to be used for judicial review before any forum, etc, can’t be permitted by the court unless there is a set procedure for authentication for the recording and a copy of the recording is preserved in court for comparison,” the judge said.

Noose tightens around lawyers

Having brought a sec tion of high-earning lawyers under the ambit of service tax last year Pranab Mukherjee has now expanded the scope of legal consultancy services bring more into the net.
If the levy was earlier limited to legal services provid ed by one business entity another (transactions between collectives such as firms, en terprises and companies), would now apply to individual lawyers and clients as well, in certain situations.
Also, legal services com ing under the service tax net has been expanded to include service of appearance before any court of law or any statutory authority, under ‘‘representational services’’.
Representational services provided to individuals will continue to be exempt. They will attract service tax when the client is a business entity, irrespective of whether the service provider is a firm or an individual lawyer.
On other legal services in relation to advice, consultancy or assistance in any branch of law, only law firms remain liable to pay service tax. The change is, they will now pay service tax even when clients are individuals.
Arbitration too will invite service tax. The levy will be on the tribunal arbitrating for a business entity.

Petition can be filled on all working days between 10.00 A.M. to 4 .30 P.M. at 7th Floor, 'B' Wing, Janpath Bhawan, Janpath New Delhi. Consumer Complaint should be signed by the complainant and supported by an affidavit with four copies, and one set each for Opposite Parties. The Consumer Complaint along with all the copies should be paginated and duly indexed in the following seriatim:-
Consumer Complaint (CC) – 21(a) (i)
1. Index
2. List of Dates
3. Memo of Parties
4. Complaint with affidavit
5. Limitation, if any (2 years from cause of action)
6. Supporting documents in favour of complaint e.g. Receipt, voucher etc
7. Fee for Rs.5,000/- for making Consumer Complaint (Demand Draft in the name of “The Registrar, NCDRC, New Delhi”)
Note:
1. The documents shall be filed in English language only or translated copy of any other language.
2. If the documents are not filed in order in the format mentioned above the same will be returned to the parties at the counter itself without acknowledgement and will only be registered after removing the defects.

शीला और बुखारी के खिलाफ अवमानना की याचिका

एक रेजिडेंट्स असोसिएशन ने दिल्ली हाई कोर्ट में याचिका दायर कर दिल्ली की मुख्यमंत्री शीला दीक्षित और जामा मस्जिद के शाही इमाम सैयद अहमद बुखारी के खिलाफ अवमानना की कार्यवाही शुरू करने की मांग की है। असोसिएशन ने कहा है कि एक अवैध मस्जिद को गिराने के बाद डीडीए ने दोबारा उस पर कब्जा कर लिया था लेकिन दोनों नेताओं ने लोगों को इस सरकारी जमीन से गुजरने और वहां नमाज अदा करने के लिए भड़काया।

जंगपुरा रेजिडेंट्स वेल्फेयर असोसिएशन ने वकील आर. के. सैनी के जरिए अपने अप्लिकेशन में शीला दीक्षित और बुखारी के अलावा मटिया महल इलाके के विधायक शोएब इकबाल और ओखला के विधायक आसिफ मोहम्मद खान के खिलाफ भी स्वत:संज्ञान लेते हुए अवमानना कार्यवाही करने की मांग की। असोसिएशन ने आरोप लगाया, कोर्ट के आदेशों का जानबूझकर उल्लंघन करने के लिए स्वत : संज्ञान लेते हुए आपराधिक कार्यवाही शुरू की जानी चाहिए।

Requirements to Register a Society
The requirements to register a society are as given below:
1. A minimum of seven members, each having the same objectives.
2. A Memorandum of Association.
3. A set of rules and regulations.
Memorandum of Association
It is a charter of society. It must clearly specify the aims and objectives of the society because a society can function only according to the objectives stated in the Memorandum. It is ultra vires(beyond one’s power) for a society to act beyond the scope of its memorandum. When the action is ultra vires of the society it is not valid in the eyes of the law, even if approved by every member of the society.
Content of the Memorandum of Association
Memorandum of Association should contain the following:
1. The name of the society.
2. The address of the society from where it operates.
3. The aims and objectives in detail.
4. The names, addresses and the occupations of the governing body members to whom the management of its affairs are entrusted.
5. The name, addresses and occupations of the remaining founding members.
Rules and Regulations
The matters on which rules and regulations are made
1. Eligibility for membership.
2. Membership fee.
3. Disqualification of members.
4. Appointment of the President, Vice President, Secretary and Treasurer.
5. Powers and function of the Governing Body
6. Powers and functions of the President, Vice President, Secretary , Treasurer.
7. Date of the Annual General Body Meeting.
8. Frequency of the ordinary and extraordinary meeting of the Governing Body.
9. Quorum(minimum number of members to be present for the meeting to be held) for the Governing Body meeting.
10. Manner of voting.
11. Property of the Society-how it is vested.
12. Suit by or against the society.
13. Procedure for alteration of modification of the Memorandum of Association and the rules and regulations.
14. Procedure for the dissolution of the society.
15. Appointment of auditors.

Procedure of Registration
When the Memorandum of the Association , a certified copy of the rules and regulations and a copy of the report of the proceeding of the general meeting( at which the resolution to register the society was passed) are filed, the Registrar of the Societies of that area will issue a certification of Registration. The fee for registration is usually Rs. 50.

Legal Implication and Advantages of Registration
By registration, an unregistered society becomes a legal person( entity). This legal status makes it more convenient for carrying out the purpose for which the unregistered society has existed.
As a legal person the society has an existence apart from that of its members. It acquires a name. It can hold property in its name. It can sue and be sued. Any person having a claim against the society can recover it from the property of society. The members may come and go but the society remains till it legally dissolved.

Effect of not Registering
If it is not registered it does not acquire a legal or judicial status. In such a society as such does not have a separate status. But all the trustees in charge of the fund or property together have a legal status.
Without registration the society would have the character of an association only. It can then sue or be sued only in the name of all the members.

Modifications of the Objectives
A society can amend or modify its aims and objectives.
When the Governing Body feels that it is advisable to alter, extend or cut short the aims and objectives of the society or to join the society with another society, it may submit a written report to all the members and convene a special meeting for consideration of the proposal. The above report must be delivered or sent by post to every member ten days before the special meeting.
The proposal ton alter the objectives must be agreed upon by the votes of 60% of its members delivered in person or by proxy. The above agreement must again be confirmed by 60 % of its members present at a second special meeting convened by the Governing Body at an interval of one month after the former meeting.

Account
Every society must keep at its registered office proper books of account. The books of account must contain:
1. The amount of money received and its source.
2. The expenditure and the purpose for which the money was used.
3. The assets and liabilities of the society.
The auditor must submit a report showing the extract state of the financial affairs of the society. Three copies of the balance sheet and the auditors report shall be certified by the auditor.

Dissolution
In order to dissolve the society 60% of its members must express their wish by their votes delivered in person or by proxy at a general meeting held for that purpose. After passing that resolution all the necessary steps must be taken by the Governing Body for the disposal and settlement of the property of the society and its claim and liabilities, according to the rules of the society. In the event of any dispute arising among the Governing Body members or members of the society , the settlement of its affairs must referred to the principal court of original civil jurisdiction of the district in which the main building of the society is situated. After considering the matter, the court will make relevant orders.

Now one question arises in our mind “Can the assets of a society be distributed among the members after its dissolution?”
No. Upon the dissolution of a society, if any property or asset remain after paying all claim and debts, it cannot be divided among its members but must be given to any other society having similar objectives. Otherwise it will be vested in the Government.
To which society the above property be given, is to be decided by 60 % present ( through vote) personally or by proxy at the time of the dissolution. In case of any dispute, the matter will be decided by the court.

Where it appears to the court that there exist elements of a settlement which may be acceptable to the parties, the court shall formulate the terms of settlement and give them to the parties for their observations and after receiving the observation of the parties, the court may reformulate the terms of a possible settlement and refer the same for-
A. arbitration;
B. conciliation
C. judicial settlement including settlement through Lok Adalat; or
D. mediation.
Where a dispute had been referred-
a) for arbitration or conciliation, the provisions of the Arbitration and Conciliation Act, 1996 shall apply as if the proceedings for arbitration or conciliation were referred for settlement under the provisions of that Act.
b) to Lok Adalat, the court shall refer the same to the Lok Adalat in accordance with the provisions of sub-section (1) of section 20 of the Legal Services Authority Act, 1987 and all other provisions of that Act shall apply in respect of the dispute so referred to the Lok Adalat;
c) for judicial settlement, the court shall refer the same to a suitable institution or person and such institution or person shall be deemed to be a Lok Adalat and all the provisions of the Legal Services Authority Act, 1987 shall apply as if the dispute were referred to a Lok Adalat under the provisions of that Act;
d) for mediation, the court shall effect a compromise between the parties and shall follow such procedure as may be prescribed.

भगत सिंह की भांजी लड़ रही हैं 21 साल से न्याय की जंग

शहीद-ए-आजम भगत सिंह के परिजन अपने एक रिश्तेदार को न्याय दिलाने के लिए पिछले 21 साल से कानूनी लड़ाई लड़ रहे हैं। ऐसा माना जाता है कि जब पंजाब में आतंकवाद चरम पर था उस दौरान पुलिस ने उनके रिश्तेदार की हत्या कर दी थी। वह 1989 से ही लापता हैं।

भगत सिंह की भांजी सुरजीत कौर के परिवार को उम्मीद है कि वे 45 साल के कुलजीत सिंह दहत के लिए न्याय हासिल कर सकेंगी। अम्बाला के जत्तन गांव के रहने वाले कुलजीत 1989 में रहस्यमय ढंग से गायब हो गए थे।

सुरजीत कौर,भगत सिंह की छोटी बहन प्रकाश कौर की बेटी हैं। वह कहती हैं कि उनके नजदीकी रिश्तेदार कुलजीत को 1989में होशियारपुर के गरही गांव से पंजाब पुलिस ने पकड़ा था। उन दिनों (1981-95) पंजाब में सिख आतंकवाद चरम पर था।

इसी सप्ताह सुप्रीम कोर्ट ने पंजाब व हरियाणा हाई कोर्ट को मामला समाप्त करने के दिशा-निर्देश दिए हैं और होशियारपुर के सेशन कोर्ट को इस साल के मार्च तक मामले में सुनवाई पूरी करने के लिए कहा है। जिसके बाद से सुरजीत को न्याय मिलने की उम्मीद जगी है।

सुरजीत का परिवार 1989 से ही कुलजीत की रिहाई के लिए प्रयासरत था। बाद में पुलिस ने कहा कि जब कुलजीत को हथियारों की पहचान के लिए ब्यास नदी के नजदीक ले जाया गया था तो वह उसकी गिरफ्त से निकलकर भाग गया था।

प्रकाश कौर ने सितंबर 1989 में सुप्रीम कोर्ट में एक याचिका दायर की थी। इसके बाद सुप्रीम कोर्ट ने मामले की जांच के लिए एक न्यायिक आयोग गठित किया। आयोग ने अक्टूबर 1993 में अपनी रिपोर्ट सौंपी। इस रिपोर्ट में पंजाब पुलिस अधिकारियों की ओर इशारा किया गया और कहा गया कि पुलिस की कुलजीत के भागने की कहानी काल्पनिक है।

सुरजीत ने बताया कि जांच रिपोर्ट आने के बावजूद अक्टूबर 1996 तक मामले में कुछ नहीं हुआ। साल 1996 में सुप्रीम कोर्ट ने इस मामले में पंजाब पुलिस के 5 अधिकारियों के खिलाफ अपहरण का मामला दर्ज करने का आदेश दिया। कई सुनवाइयों और 21 साल तक चली लंबी लड़ाई के बावजूद हम मामले में न्याय मिलने की उम्मीद कर रहे हैं।''

लड़की बालिग, लड़का नाबालिग; पुलिस क्या करे

कर्नाटक के चित्रदुर्ग जिले की पुलिस को इन दिनों एक अजीबोगरीब मामले से दो-चार होना पड़ रहा है और इसे सुलझाने में उसके हाथ-पांव फूल गए हैं। 32 साल की एक संन्यासिन ने 20 साल के एक युवक से शादी कर ली है। युवक की मां ने संन्यासिन निवेदिता के खिलाफ बाल विवाह निरोधक कानून के तहत मामल दर्ज कराया है। लेकिन पुलिस की मुश्किल यह है कि इसी कानून ने उसके हाथ बांध रखे हैं।

पुलिस का कहना है कि इस कानून के मुताबिक, 18 साल से कम उम्र लड़की से शादी करने वाले पुरुष के खिलाफ तो कार्रवाई की जा सकती है। लेकिन अगर कोई महिला किसी 21साल से कम उम्र के लड़के से शादी करती है, तो कानून इस पर खामोश है। जिले के एसपी लभू राम अपनी लाचारी जताते हुए कहते हैं कि मैं समझ नहीं पा रहा हूं कि क्या करूं।

उन्होंने बताया कि लड़के चेतन की मां रत्नामा ने अपने बेटे को नाबालिग साबित करने के लिए जरूरी कागजात भी पुलिस के सुपुर्द कर दिए हैं। इनमें चेतन की जन्म की तारीख 1 फरवरी, 1990 दर्ज है। एसपी ने कहा कि अभी तो सिर्फ इतना कह सकता हूं कि जांच जारी है।

रत्नामा ने कुछ समय पहले निवेदिता के खिलाफ किडनैपिंग का केस भी दर्ज कराया था। लेकिन बेटे ने बाद में साफ कर दिया था कि वह निवेदिता के साथ अपनी मर्जी से रह रहा है। लभू राम ने बताया कि चेतन का बयान दर्ज करने के बाद रत्नामा ने नई शिकायत दर्ज कराई है कि चेतन अभी नाबालिग है और उसकी शादी नहीं कराई जा सकती है।

बताया जा रहा है कि रत्नामा हाई कोर्ट जाने पर भी सोच रही है क्योंकि चेतन अगले आठ महीने में बालिग होने वाला है। रत्नामा ने कहा है कि अगर पुलिस कुछ नहीं कर सकी,तो वह हाई कोर्ट का दरवाजा खटखटाएगी। उसने कहा कि मैं अपने बेटे को लेकर चिंतित हूं। हमारे पास ज्यादा समय नहीं है। मैं अपने बेटे को उस महिला के चंगुल से छुड़ाना चाहती हूं। हालांकि पुलिस का कहना है कि हाई कोर्ट से भी रत्नामा को कुछ खास हासिल नहीं होगा।

कोर्ट ने मुन्नी बदनाम हुई को अश्लील माना

दमोह। मध्य प्रदेश की एक स्थानीय अदालत ने फिल्म 'दबंग' के विवादास्पद गीत 'मुन्नी बदनाम हुई' को अश्लील करार दिया है। दमोह की अदालत ने यह गाना गाकर एक दलित युवती से छेड़खानी करने वाले तीन आरोपियों की अग्रिम जमानत अर्जी खारिज कर दी।

विशेष न्यायाधीश एस.बी. भार्गव ने मंगलवार को अपने फैसले में कहा कि इस गाने से मुन्नी नाम की महिलाओं के लिए अच्छा संदेश नहीं जाता। अभियोजन के अनुसार दमोह के कंजई गांव में रहने वाली ममता उर्फ मुन्नी को गांव के तीन दबंग ओंकार, मिथुन और पप्पू राय मुन्नी बदनाम हुई गाना गाकर परेशान करते थे।

ममता ने जब एक दिन इसका विरोध किया तो उन्होंने उसके साथ छेड़छाड़ शुरू कर दी। ममता की शिकायत पर पुलिस ने उनके खिलाफ मामला दर्ज कर लिया। पुलिस में शिकायत पहुंचने के बाद से तीनों फरार हैं। अपनी गिरफ्तारी की संभावना को देखते हुए उन्होंने अग्रिम जमानत की अर्जी लगाई थी।

Supreme Court of Inida woman judge lists daughters as ‘liabilities’

It is a line that even Bollywood has banished for a while now. But while declaring her assets and liabilities, sitting Supreme Court judge Gyan Sudha Mishra, the only woman judge in the SC at present, has listed the marriage of her two daughters in the "liabilities" column, apparently without considering anything to be much amiss.

The SC's official website in its assets of sitting judges column gives Justice Mishra's declaration where she lists "two daughters to be married" against the liabilities column. While this might be a sentiment still shared by a section of the middle class, it could be regarded as being very politically incorrect, especially on the part of the country's seniormost woman judge.

Other entries in the liabilities column are "guarantor for education loan of my daughter" and residential house to be built post-retirement. The view that daughters are a "liability" (often because of the high cost of their marriage), or a burden of some sort, is a notion that the government is fighting to eradicate through many campaigns.

The declaration is likely to attract comment as it is does not seem in sync with the SC's otherwise progressive image on social issues in general and women's rights in particular. It could be seen to be betraying a thinking on which the SC is often called to deliberate on while handling sensitive gender parity cases.

The assets Justice Mishra, who formerly headed the Chhattisgarh high court, has declared are not out of the ordinary. "Stridhan" of one gold set and "few gold rings and a pair of bangles" are listed under jewellery. There are no shares or mutual funds and fixed deposits total just Rs 5 lakh.

Justice Mishra has a PPF of Rs 3 lakh and has listed her VIth pay commission arrears as well. Her landed property includes an original allottee of one flat in a society for judges and lawyers in Mayur Vihar in Delhi and a residential plot in Faridabad. The flat and plot cost Rs 5 and Rs 6 lakh at purchase though their value would be much higher now.

She has shown nothing to declare under the vehicle column while her spouse owns just one Maruti 800. He also has an office space in Rani Bagh purchased in 1999 for Rs 4 lakh and one unregistered residential plot in Fraidabad. He is also claimant to a share in joint family property in Dhanbad.

HC orders pension to freedom fighter’s widow

The Madras High Court bench here has ordered the Madurai North Treasury officer to pay Rs 5,000 towards cost to 82-year-old widow of a freedom fighter for “deliberately delaying” the payment of her family pension.
In his order Justice N Paul Vasanthakumar said the though the Central government had issued order to pay pension for the widow, treasury officer had delayed the payment after her husband died On September 3, 2005.
The treasury officer had made an aged woman come to the court unnecessarily, the Judge said and ordered him to pay the widow Rs 5,000 towards cost and also settle pension arrears and pension from 2005 within two weeks.
The petitioner Rajalakshmi submitted that her husband Solamalai was a freedom fighter and he was in prison during freedom struggle between 1940 and 1943. He was given pension by both Central and State governments.
Her husband died in 2005 and she had applied for payment of family pension to her. While the state pension for widow had been paid the pension by the Central government for widow had not been paid. “I gave several representations but there was no response” she said and prayed for an order to the authorities to settle the pension.

Petition seeks to declare National Green Tribunal Act unconstitutional

A student of the School of Excellence in Law has filed a writ petition in the Madras High Court seeking to declare the National Green Tribunal (NGT) Act 2010 as unconstitutional.
In his public interest litigation petition, M. Naveen Kumar, studying B.A., B.L. (Hons) course here, said that the Act received Presidential assent on June 2 this year. The legislation provided for constitution of the Tribunal for effective and expeditious disposal of cases relating to environmental protection, conservation of forests and other natural resources and giving relief and compensation for damage. By virtue of this law, the National Environmental Tribunal Act and the National Environment Appellate Authority Act were repealed. The cases pending before the two forums stood transferred to the NGT. The petitioner said in cases where substantial questions relating to environment was involved, the High Courts were exercising their writ jurisdiction to provide remedy to the affected people. The blanket ban imposed under the new Act on the jurisdiction of civil courts expressly and the High Courts impliedly would be impermissible in law. Right to judicial review before the High Court had been recognised as part of the basic structure of the Constitution.
The constitution of NGT and by excluding all environmental matters from the jurisdiction of the High Court and Civil Courts would severely affect the right of access to justice to the poor and the needy. Also, the Act provided for constitution of the tribunal at the national level and circuit benches. The court has ordered notice on the petition.

From trial to jail, it takes just 3 months in China

Gavel in judge's hand is itself a deterrent against wrongdoing

In China it takes a maximum of three months for getting an accused tried for an offence, convicted and sent to jail. Civil or commercial disputes are either settled or decided within six months.
The entire judiciary, from the lower court to the highest court, is well connected through a computer network with each judge having every information in front of him/her. The court hall looks like a corporate office with state-of-the-art technology put in place in its day-to-day functioning. A mere look at the court hall gives an impression that the gavel in the judge's hand will act as a deterrent against wrongdoing.
The case management system with well-knit archives is so scientific that every information is displayed on the screen for the benefit of litigants and judges, the moment a case is taken up for hearing.
In a criminal case, information on the accused, including the thumb impression, weapons seized from the scene of occurrence, and witness depositions and statements can be obtained on the computer screen during the hearing/trial for ready reference by defence counsel, the prosecution and the judge.
This is what a delegation of the International Council of Jurists (ICJ) came to know from Justice Jing Hanchao, vice-president of the Supreme People's Court of China (SPCC), during a visit there.
The delegation, led by Justice V.S. Sirpurkar of the Supreme Court and including ICJ president Adish Aggarwala; Director S. Prabhakaran, Mizoram MP C.L. Ruala, advocate L.D. Rajendra Prasad, got first-hand information on the functioning of the Chinese judicial system. Members M. Antony Selvaraj and Yatin Reddy; Justice Ali Hameed Mohamed of the Supreme Court of Maldives; and Justice P.R. Walagama of the High Court of Colombo, Sri Lanka, were present.
The crime rate is very low in China with criminal cases accounting for only six per cent of the total. With China's economic and trade relations with other countries growing by leaps and bounds, civil or commercial cases account for 68 per cent. As a result, it has been mandated in the civil procedural law that every attempt be made by the court for settling a commercial dispute through mediation/arbitration by a committee of mediators. The mediators' report is final and the court incorporates it as a final decree for acceptance by both parties.
Justice Jing said 10 million cases were being handled by the various courts in China, the SPCC alone accounting for about 10,000 cases. Once final arguments started, the case would be completed in a day or two. In certain important cases, arguments could stretch for about 10 days. The written judgments would be not more than four-five pages and the final decision would be incorporated in one page. Asked whether the SPCC came across corruption cases against civil servants, Justice Jing said “not many,” “only very few cases,” and they would be decided within three months.
Justice Sirpurkar lauded the mediation system in China and suggested frequent exchange programmes which would enable Indian mediators to understand the Chinese model and vice versa. When Mr. Aggarwala invited a Chinese team to visit India in the context of growing economic and trade relations, Justice Jing said he had visited the country in 2007 and expressed a desire to come to India again, as it would help in a better understanding of the Indian legal system.
Mr. Prabhakaran felt that the stringent mechanism for implementation of court orders was worthy of emulation in India, where more often than not orders were breached with impunity, necessitating the courts invoking contempt provisions.
Earlier, the delegation visited the Beijing High People's Court and interacted with Justice Herong, vice-president, HPC, and other judges. It also exchanged ideas with All-China Lawyers Association president Yu Ning.

Govt: Prosecution of errant babus must be completed in a year

Having been embarrassed over the appointment of P J Thomas as central vigilance commissioner while a sanction for prosecution was pending against him for 10 years, the Centre is looking to streamline disciplinary action to ensure the process does not take more than a year.
Apart from the most obvious hurdle to Thomas’s candidature in the form of a chargesheet in the palmolein case, the Centre tripped over the prosecution file lying in the DoPT on which no view was taken. While the sanction for prosecution deals with cases that will be tried in court, the government is considering whether it can complete disciplinary proceedings where it decides penalties within a fixed timeframe. The issue of prosecution sanctions should need less than a year.
While in the palmolein case Thomas has argued he has not been able to plead his case in the trial court because of repeated stays obtained by the late K Karunakaran, it has been often found that by the time DoPT takes a view on a prosecution request or a disciplinary matter, the officer has retired. At other times he or she is simply untraceable.
The DoPT is looking to speed up its proposals on assessing sanctions and may also consider the need for a “speaking order” when a request is rejected. As of now no explanation is called for denying sanction. Detailing reasons would be a step towards a more transparent regime in a situation where the bureaucracy is judging its own brethren. When contacted, cabinet secretary K M Chandrasekhar said the government wanted to ensure requests for sanction or disciplinary action are dealt with thoroughly and promptly.

Mediation cell at consumer commission

Delhi state consumer commission is reeling under the pressure of mounting backlog of pending cases due to growing awareness among consumers about their rights and mounting appeals. To deal with this problem, the commission has now come up with a new way of resolving disputes.
With the launch of its own mediation centre, consumer courts have facilitated litigants to avoid going through a protracted litigation and instead take their complaint to the mediation centre where they can resolve their disputes without the hassle of court hearings. Celebrating the National Consumer Day on Friday, officials said that the move is proving beneficial as there are cases that have been pending for as long as eight years.
According to the official data, around 600 appeals, which come from 10 different district consumer forums, and around 700 other cases are pending before Delhi state consumer commission. “Despite having a good disposal record, cases keep coming and hence a backlog is created making it difficult to deal with them,’’ said a Delhi state consumer commission official.
The official added that the mediation centre is now helping the court in settling the disputes amicably between the parties and, hence, it becomes a favourable option among litigants as they do not have to hire a lawyer to fight their cases.
Though the Consumer Protection Act provides the consumer with an option of presenting their appeal before the court without engaging a lawyer, very few exercise this option. “The mediation centre is an inexpensive way to settle disputes,’’ official said.
Nand Kumar, a consumer who had come to the district consumer forum with his complaint against a hospital, jumped at the idea of the mediation centre and said he plans to approach it as that will save him from the hassle of hiring a lawyer and coming for court hearings.

आरटीआई के तहत सूचना देने से इनकार पर राज्यपाल को समन

गोवा के सूचना आयोग ने राज्यपाल भवन द्वारा एक सामाजिक कार्यकर्ता को सूचना के अधिकार (आरटीआई) के तहत जानकारी मुहैया नहीं कराने जाने पर राज्यपाल डॉ. एस. एस. सिद्धू को समन जारी किया है। पणजी से आई खबरों के मुताबिक सामाजिक कार्यकर्ता आइरिस रोड्रिग्स ने राज्य सूचना आयोग में शिकायत दर्ज कराई थी कि राज्यपाल ने उन्हें महाधिवक्ता सुबोध कंटक से संबंधित जानकारी देने से इंकार कर दिया।
सूचना आयुक्त मोतीलाल केनी के हस्ताक्षरित नोटिस में राज्यपाल को आयोग के सामने उपस्थित होने के लिए कहा गया है और आगाह किया गया है कि अगर उन्होंने समन की अवहेलना की, तो उनकी मौजूदगी के बिना ही शिकायत पर फैसला कर लिया जाएगा। गत 29 नवंबर को रोड्रिग्स ने राजभवन से गोवा के महाधिवक्ता के खिलाफ दर्ज उनकी शिकायत पर की गई कार्रवाई की जानकारी मांगी थी। रोड्रिग्स ने नोटिस की प्रतिकृति और उनकी शिकायत पर की जा रही प्रक्रिया की भी जानकारी की मांग की थी। राज्यपाल के विशेष सचिव डॉ. एन. राधाकृष्णन ने जानकारी देने से इंकार करते हुए कहा कि गोवा का राज्यपाल लोक अधिकारी नहीं है, इसलिए आरटीआई कानून राज्यपाल पर लागू नहीं हो सकता।

Delhi High Court stays eviction of disabled kiosk owner

An attempt by the Delhi high court administration to evict a mentally challenged person manning a kiosk in court premises has led two of its judges to demand an explanation. A division bench has stayed the eviction of Lalit Nautiyal from his kiosk by the HC administration and also directed that his kiosk, situated in Karkardooma court complex, not be auctioned.

Nautiyal had moved court alleging the HC administration acted unlawfully by asking him to vacate the kiosk from where he runs a photostat shop.

Nautiyal told HC that he was given the original allotment in 2001 under the handicapped quota on sympathetic grounds. Over the years, even while the lease executed in his favor expired, the court administration neither renewed his lease nor cancelled it. But in 2009, the committee in charge of maintenance of the court complex decided to auction all the kiosks and award licence for a period of three years. An alarmed Nautiyal then approached the administration, praying his allotment be continued as handing the kiosk to the highest bidder would mean robbing a handicapped person of his only source of livelihood, especially when his parents were dependent on him. 4 wives, 28 kids reform Mumbai criminal

Here's a man really committed to family life! A total of 28 children from four wives, all of whom finally got fed up with man's criminal ways and convinced him surrender to the cops in the hope it will mitigate his sentence.
Atique Shaikh (36) had been on the run for the last two years and his four wives along with the children, who live in the same Mumbai neighbourhood, put their heads together and decided to convince Shaikh to surrender.
Shaikh fell in love with all four women at different times and got married to them. They all stay in Govandi in separate houses. While his eldest son, a 17-year-old, is graduating in Arts, his 10 other children are studying in various schools in Govandi. His wives work as domestic helps and run their respective families.
According to police, it were his kids who implored him to quit crime. His children pleaded that if he continued, it would become difficult for them in school and during their weddings. "It really had an impact on his mind and he decided to heed them,'' said a police officer.
"I want a chance to get rid of my criminal identity. I want to spend life with dignity,'' Shaikh told the court on Wednesday after surrendering.
A resident of Baiganwadi in Shivaji Nagar, Shaikh has as many as 19 cases against him since 1991 and cops from at least six police stations were hunting for him. His crimes include eight cases of extortion, two of attempt to murder and nine of assault and robbery.
Assistant police inspector, Bhimrao Valatkar, who is probing the case, said, Shaikh, a habitual offender, stepped into crime in 1991. Though he has been arrested in most of the cases and trial is on, he was on the run and could not be arrested in two previous cases.
At the Kurla court, Shaikh pleaded that he wanted to spend his remaining life with dignity. He also told the court that he was worried about the future of his four wives and 28 kids, said an officer. The court remanded him to police custody till December 20. Currently, he is lodged at the Ghatkopar Central lock up.

RTI queries not beyond 250 words

In what is seen to be another attempt to tame the Right to Information Act, the government has in a recent notification recommended RTI applicants keep their application to just one subject and also limit the query to only 250 words.
Citizens asking for information under RTI may also have to pay charges that the public authority has incurred if it needs to hire equipment used in gathering and providing information.
The proposed rules have been drafted by the department of personnel and training and public comments are invited till December 27. The rules have been drafted after a Delhi HC order rejected the Central Information Commission’s powers to draft rules on RTI. The DoPT move has worried activists who feel the rules limit the empowering RTI legislation. “These are a major policy shift and not pro-RTI. They restrict citizens’ fundamental right to freedom of information and can be misused by public information officers as they place enormous discretion in the hands of the PIO to decide what constitutes one subject matter and what doesn’t,” CHRI’s Venkatesh Nayak said.
In its draft rules, DoPT has also allowed that a public authority can accept fees by cash, demand draft, bankers cheque and electronic transfers or any other means as well.
Activists feel this rule is loosely worded and can allow RTI recipients to pick means of payment and in effect block queries. Activists fear the provision calling for an appellant to be represented through an “authorized representative” may be misused. “The earlier provision said that the authorised representative other than a lawyer could be present. This has been removed to include only authorized representative, which may be interpreted by public authorities to depute lawyers to argue cases,” Nayak said. RTI activist S C Agrawal, who has been instrumental in making assets of Cabinet ministers public, said, “It is definitely an obstruction in implementation of the RTI Act.”

1300 power dispute cases settled in a day

Over 1000 cases of electricity dispute were settled on Saturday by the Delhi high court at the Weekend Lok Adalat. The special Lok Adalat, held to dispose of cases at the pre-litigative stage, saw a tremendous response when litigants flocked the high court to get their dispute settled without much hassle.
Three judges of Delhi high court efficiently disposed of 1300 cases pertaining to electricity agencies BYPL, BRPL and NDPL and also managed to settle 42 writ petitions, civil suits and criminal appeals that have been pending before the HC.
Justicees P K Bhasin, Ajit Bharihoke and A K Pathak presided over the Lok Adalat along with lawyer members and helped disputing parties reach settlement in writ, criminal and civil disputes while 20 more benches presided over by the district court judges were constituted for taking up the electricity matters at pre-litigative stage.
To ensure the smooth functioning of the Weekend Lok Adalat, Chief Justice of Delhi high court Justice Dipak Misra, who is also the Patron-in-Chief, Delhi High Court Legal Services Committee, along with Justice A K Sikri personally saw the proceedings of the Lok Adalat. The momentum of work of the benches in the court increased by afternoon with people coming in huge numbers and the HC was jampacked by evening. The huge response led to Lok Adalats working till 6pm.
With the response of Saturday’s Lok Adalat, the HC will now extend the benefit to the litigants by holding a special electricity Lok Adalat on Sunday. ‘‘It is going to be a walk-in dispute settlement option at Lok Adalats on Sunday. We expect about 1500 cases to come up before the HC and the judges will strive to settle maximum cases possible. This is the best way to sort out disputes,’’ said Gautam Manan, project officer, Delhi Legal Services Authority.

Court tells man not to subject mother to ‘legal armtwisting’

The attempt of a man to get a criminal complaint registered against his own mother has boomeranged with a trial court saying that the court cannot permit a ‘‘disgruntled son to subject his old widow mother to legal armtwisting to secure a material interest for himself’’.
‘‘The revisionist before this court is a disgruntled son who has invoked the provisions of penal legislations against his old widow mother in respect of a property, in which his mother is residing, and in respect of which civil disputes are pending before the competent courts,’’ additional sessions judge Kamini Lau said while dismissing the revision plea of the man seeking relief under Section 156(3). The son had moved the sessions court against the order of the trial court which had dismissed his prayer seeking orders to police to take action against his mother as he feared for life. As per the case, the man and his mother are fighting over a house in Hari Nagar. He alleged that he feared harm from his mother.
He said that the trial court failed to appreciate that his mother was accused of having committed serious offences of criminal intimidation, house breaking, criminal trespass, hurt, criminal conspiracy and causing mental and physical cruelty to him.

पति को नपुंसक कहा, देगी 2 लाख का हर्जाना

मध्य प्रदेश में हरदा की एक अदालत ने हज्बंड पर नपुंसकता(इम्पोटेंसी )का झूठा आरोप लगाने वाली महि ला पर दो लाख का जुर्माना लगाया है। उसे यह रकम अपने एक्स हज्बंड को देनी होगी।

एक्स हबी हेमंत छलोतरे ने एक्स वाइफ वंदना गुर्जर के खिलाफ मानहानि का मुकदमा दायर किया था। सुनवाई के बाद डिस्ट्रिक्ट एंड सेशन जज जगदीश प्रसाद पराशर ने यह फैसला सुनाया।

हेमंत और वंदना की शादी करीब नौ साल पहले हुई थी, लेकिन तीन महीने बाद ही दोनों अलग हो गए थे। वंदना ने इसके बाद भोपाल के एक थाने में हेमंत और उसके परिवार के खिलाफ दहेज के लिए सताए जाने की शिकायत भी दर्ज कराई थी। इसके आधार पर चले मुकदमे में हालांकि हेमंत और उसके परिवार को अदालत ने बरी कर दिया था।

इसके बाद वंदना ने पति के नपुंसक होने का दावा किया और तलाक की अर्जी दाखिल कर दी। अदालत ने उसकी अर्जी स्वीकार करते हुए तलाक का आदेश दे दिया। झूठे आरोप के आधार पर बेइज्जत किए जाने के बाद 2006 में हेमंत ने मानहानि का मुकदमा दायर किया था।

हरियाणा से बाहर होगी मिर्चपुर कांड की सुनवाई

हरियाणा की भूपेंद्र सिंह हुड्डा सरकार को झटका देते हुए सुप्रीम कोर्ट ने बुधवार को दलितों पर हमले के आरोपियों की सुनवाई हरियाणा से नई दिल्ली स्थानांतरित किया।

न्यायाधीश जी. एस. सिंघवी और ए. के. गांगुली की पीठ ने कहा कि स्वंतत्र एवं निष्पक्ष सुनवाई के लिए स्थानांतरण आवश्यक है।

कोर्ट ने मंगलवार को संकेत दिया था कि मिर्चपुर कांड मामले की सुनवाई हरियाणा के बाहर की जा सकती है। मिर्चपुर गांव के प्रभावशाली जाति के लोगों द्वारा दलितों पर हमला करने का आरोप है।

गौरतलब है कि गांव में गत 21 अप्रैल को वाल्मीकि समुदाय के घरों पर हमला करने के बाद उन्हें जला दिया गया था। इस हमले में तारा चंद (70) और उनकी विकलांग पुत्री सुमन की मौत हो गई।

सुप्रीम कोर्ट ने मंगलवार को कहा कि हिसार के अतिरिक्त सत्र न्यायाधीश से मिली रिपोर्ट के मुताबिक मामले में गवाहों को मुकरने के लिए बाध्य किया जा रहा है और पीडि़त पक्ष के वकील भी असुरक्षित हैं।

HC stays termination of Kings XI's IPL agreement

In a relief for Kings XI Punjab, Bombay High Court on Wednesday stayed the termination of the IPL franchise's agreement by the Cricket Board.
Justice SJ Vazifdar remarked that going by the documents, Kings XI had "made out a strong case".
The dispute will now again go before a new arbitrator - earlier arbitrator Justice BN Srikrishna having recused himself - but as of now Kings XI will be able to participate in the players auction in January.
Kings XI will have to, however, furnish bank guarantees for making up the losses that BCCI, as well as the its own players might suffer in case the arbitrator's award goes against Kings XI.
The judge also said that Kings XI will have to clear the dues of players for the previous IPL season. "It is a question of national prestige," he said.
Interestingly, Justice Srikrishna, who was arbitrator in dispute between BCCI and Rajasthan Royals, too had observed that prima facie termination of Royals' agreement was illegal.
The court also recorded a statement made by Kings XI's lawyer Darius Khambata that present share-holding pattern of owners - which includes actor Preity Zinta and industrialist Ness Wadia - will not change, and shares will not be sold without court's or arbitrator's permission.
BCCI's defence for terminating the agreement is that Kings XI's ownership pattern changed, without cricket body's consent, which was breach of a vital term in the agreement.
Court directed Kings XI to furnish bank guarantee of $18 million for the players which it might pick up in the auction, and of $3.5 million for BCCI within one month.
BCCI wanted this guarantee, as it fears potential loss of revenue by not conducting a new auction to replace Kings XI as franchisee.
Kings XI also wanted extension of Wednesday's deadline for signing up the marquee players, but court refused to entertain the plea.

A Delhi-based yoga guru has been sent to jail for failing to pay maintenance to his former wife

A Delhi-based yoga guru, whose clientele includes political bigwigs to fashionistas, has been sent to jail for failing to pay maintenance to his former wife.
His former wife accused him of not paying maintenance after divorce He has not paid a single penny to his wife even after the court orders.
According to a metropolitan magistrate court order in April 2010, Laviral (name changed) was required to pay R35,000 per month in maintenance to his former wife. However, he failed to pay a “single penny all these months“.
The yoga guru got married to Sheila (name changed), daughter of a former vice-chief of the Indian Air Force, in 2004.
Soon after her marriage, Sheila accused her husband of trying to grab her parents' properties in Defence Colony. She sought a divorce from him in 2008. The couple has a three-year-old son from their marriage.
In April 2010, the court had found him adulterous by nature and imposed a maintenance of R35,000 per month.
In October 2010, Sheila, through her counsel Prabhjit Jauhar, filed a complainant in the court, accusing the yoga guru of non-payment of maintenance.
“He has not paid a single penny to his wife and son even after the court orders of April 2010. He even failed to pay the arrears from the date of the divorce case filed in 2008,“ Jauhar told the court. Earlier, the court had restrained Laviral from visiting his child, saying his “treacherous behaviour could influence the child“.
However, the counsel for Laviral argued that in the previous order, the court had not considered all aspects of the case and wrongly imposed the maintenance cost.
In the latest order, metropolitan magistrate Priya Mahendra observed that circumstances have remained unchanged for Sheila despite court orders giving her relief. The court, therefore, ordered civil imprisonment to Laviral for a month for failing to pay the maintenance amount since October 2009. “As per law, he could go to jail every month for delay in payment from October 2009 till date,“ Jauhar told the Hindustan Times.

Legal Alert of the Day::Demand for dowry can’t be a proof for conviction: HC सजा के लिए दहेज की मांग ही पर्याप्त सुबूत नहीं: कोर्ट

Demand for dowry on the part of husband and inlaws is itself not sufficient evidence to convict them for the unnatural death of a woman, the Delhi high court has said.
The court said it is essential to prove that the victim was being harassed in order to convict aperson for dowry death.
“Mere making of demand is not the only pre-requisite for proving an offence under Section 304B IPC. The prosecution was thus, supposed to prove that demand made by accused was coupled with harassment or cruelty in connection with the demand,” Justice S N Dhingra said.
The bench acquitted a man after cops failed to provide credible evidence to substantiate that he or any of his family members were harassing his wife for dowry. The witness had only said the family members were demanding dowry from the victim’s family.
“Unnatural death can be called a dowry death only if, after making a demand of dowry, the accused perpetuates cruelty on the victim so that his demand gets fulfilled. If the alleged demand of dowry is not coupled with cruelty, harassment or any other such act, the case of dowry death would not be made out,” the bench said.
The bench acquitted the man after none of the three brothers of the victim, who had alleged that dowry was being demanded, stated that their sister was harassed by her in-laws.
The court set aside the trial court verdict which had convicted the man and sentenced him to life imprisonment for killing his wife for dowry. “Every suicide after marriage cannot be presumed to be a suicide due to dowry demand,” the court said.

दिल्ली हाई कोर्ट का कहना है कि पति और सास-ससुर अगर दहेज की मांग करते हैं और पत्नी या बहू की अस्वाभाविक मौत हो जाती है, तो आरोपियों को सजा देने के लिए दहेज की मांग पर्याप्त सुबूत नहीं है।
कोर्ट ने कहा कि यह साबित किया जाना जरूरी है कि पीड़ित को प्रताड़ित किया गया,तभी किसी व्यक्ति को दहेज के मामले में सजा दी जा सकती है।
न्यायाधीश एस. एन. धींगरा ने कहा कि सिर्फ दहेज की मांग किसी को आईपीसी की धारा 304 बी के तहत सजा देने के लिए काफी नहीं है। पीड़ित को यह साबित करना होगा कि दहेज की मांग के साथ प्रताड़ित भी किया गया।
कोर्ट ने एक ऐसे ही मामले में एक आरोपी को बरी कर दिया जिसे दोषी साबित करने के लिए पुलिस ठोस सुबूत पेश नहीं कर पाई। पुलिस यह साबित नहीं कर पाई कि आरोपी या उसके परिवार के किसी सदस्य ने दहेज के लिए पत्नी को प्रताड़ित किया। इस मामले में गवाह ने केवल इतना कहा कि पीड़ित के परिवार से दहेज की मांग की जा रही थी।
कोर्ट ने कहा कि अप्राकृतिक रूप से हुई मौत को दहेज के मामले में हुई मौत तब तक नहीं बताया जा सकता जब तक कि यह साबित नहीं होता कि पत्नी या बहू को प्रताड़ित किया गया। दहेज की कथित मांग के साथ प्रताड़ना या बर्बरता का मामला नहीं है,तो दहेज की वजह से हुई मौत का मामला नहीं बनता।

In one case,husband was living with his aged mother as his father died in his childhood, it was not possible for him to leave his mother alone and to live at the house of the parents of the wife as Ghar Jamai. It has been further averred that when he refused to live at her parents house, the wife harassed him, and threatened to involve him and his family members in a false criminal case.
In another case, wife was employed but not accounting for her salary to the husband nor disclosing where she used to spend it staying away with her parents of and on without informing her husband. Refused to live with husband and rather the wife and her mother pressing him to live at the house of her mother as ghar jamai. All these acts amount to cruelty.

सेक्स की सजा 100 कोड़े

संयुक्त अरब अमीरात के शारजाह में एक बांग्लादेशी पुरुष को 100कोड़े और देश निकाला की सजा सुनाई गई है। उसके ऊपर आरोप था कि उसने अपनी महिला मित्र के साथ सेक्स किया है। बिना शादी के सेक्स करना वहां अपराध की श्रेणी में आता है। उसकी महिला मित्र फिलिपीन की रहने वाली है और वहां मेड का काम करती है। वह जिस घर में काम करती थी उसकी मालकिन ने सूचना दी कि उसने दोनों को सेक्स करते देखा है।

महिला का पुरुष मित्र छुपकर घर में घुसा करता था। किसी के घर में चोरी से घुसकर ऐसी हरकत करना भी वहां अपराध की श्रेणी में आता है। दोनों ने कोर्ट के सामने सेक्स की बात मान ली है। दोनों के मुस्लिम होने की वजह से उन्हें कड़ी सजा दी गई है। सूत्रों ने बताया कि उसे एक साल की जेल भी हो सकती है।

RTI EXPOSES GOLD MEDAL POLICY IN JAMIA UNIVERSITY

Award of Gold medal to students – to be decided on merits or to be awarded as a matter of tradition? The matter was put before Delhi High Court vide a petition subsequent to a protracted wrestle with Jamia Milia University. The petitioner Sh. Aishwarya Pathak sought the information from JMI under the RTI Act as to any guidelines regarding selection of candidates for award of Gold medal. However, it was a bolt from the blue to hear from the venerated University that there are no guidelines for conferring gold medals and it is rather a matter of tradition which has been followed for many years. Considering the enormity of the matter Hon’ble High Court decided that the matter was in the nature of a public interest litigation.
The matter has raised a question mark on the entire mechanics of selection of meritorious candidates who toil hard to get ranks but their efforts and results are not accredited in the garb of some “followed procedures”. One school of thought aligns the matter with the right to education, but is it such a momentous issue or has the potential to become one if followed after other RTI applications to confront some time-honoured approaches that have plagued the education system. One amongst us has unearthed these flawed procedures and we are ardently waiting for the matter to be taken up by the Apex Court next month to decide on the question of MERITS Vs TRADITION.

रेप पीड़ित महिलाओं को सरकार देगी मुआवजा

रेप का शिकार होने वाली महिलाओं को जल्द ही अब आर्थिक सहायता भी मिलने लगेगी। महिला और बाल कल्याण मंत्रालय की ओर से तैयार किए गए इस प्रस्ताव को फाइनेंस कमिटी की मंजूरी मिल गई है कि रेप पीड़िताओं को आम तौर पर 1.30 लाख रुपए की और खास मामलों में 3 लाख रुपए तक की सरकारी मदद मिले।
वित्त मंत्रालय की मंजूरी के लिए भेजे गए इस प्रस्ताव के मुताबिक रेप का शिकार होने वाली महिलाओं को 20,000 रुपए की नकद सहायता मिलेगी। इसके अलावा उन्हें लीगल सहायता, आश्रय आदि के रूप में 50,000 रुपए तक की सहायता मिल सकती हैं। जरूरत के मुताबिक कुल सहायता 1.30 लाख रुपए तक की हो सकती है।
प्रस्ताव के मुताबिक अगर पीड़िता शारीरिक तौर पर अपंग,मानसिक रूप से कमजोर या एचआईवी पीड़ित या संक्रामक यौन रोगों से ग्रस्त हो तो कुल सहायता राशि 3 लाख रुपए बढ़ाई जा सकती है।
महिला एवं बाल विकास मंत्री कृष्णा तीरथ ने कहा,'रेप महिलाओं के खिलाफ किया जाने वाला सबसे हिंसक अपराध है जो उन्हें लंबे समय तक सामाजिक, मानसिक और भावनात्मक स्तर पर पीड़ित बनाए रखता है। प्रस्तावित उपायों के जरिए ऐसी महिलाओं को तात्कालिक राहत देने के साथ-साथ दीर्घकालिक समस्याओं से निपटने में भी उनकी सहायता कर सकेंगे।'

दिल्ली हाई कोर्ट ने दिल्ली सरकार को नोटिस जारी कर पूछा है कि कथित रूप से भारत के खिलाफ भाषण देने के लिए क्यों न कट्टरपंथी हुर्रियत नेता सैयद अली शाह गिलानी, लेखिका अरुंधती राय और दिल्ली यूनिवर्सिटी के प्रफेसर एस. ए. आर गिलानी के खिलाफ आपराधिक मामला दर्ज किया जाए।
न्यायमूर्ति हीमा कोहली ने एक याचिका पर दिल्ली सरकार से जवाब देने को कहा है। इस याचिका में अरुंधती और बाकी के खिलाफ देशद्रोह और कई अपराधों के आरोप में आपराधिक मुकदमा चलाए जाने की मांग की गई है।
याचिकाकर्ता के वकील सुग्रीव दुबे ने कहा कि सरकार को भारतीय दंड संहिता की धारा 124 ए के तहत कार्रवाई करने का निर्देश दिया जाना चाहिए।
सुग्रीव ने 25 अक्टूबर को अरुंधती और बाकी के भाषण का जिक्र करते हुए कहा कि स्वतंत्रता में कभी भी राष्ट्र हित के खिलाफ विचारों के प्रसार की आजादी शामिल नहीं रही और यह सुनिश्चित करना चाहिए कि निर्दोष लोगों को भड़काने के उद्देश्य से भाषण की इजाजत नहीं दी जाए। वकील के मुताबिक राय ने अपने भाषण में कहा था कि जम्मू कश्मीर भारत का अभिन्न हिस्सा नहीं है और उन्होंने राज्य के युवकों से कश्मीर के लिए बलिदान करने का आह्वान किया था।
सुग्रीव की दलीलें सुनने के बाद अदालत ने मामले की अगली सुनवाई की तारीख 27 जनवरी तय की और दिल्ली सरकार से 27 जनवरी तक अपना जवाब दाखिल करने को कहा।
भारत विरोधी भाषण देने के लिए हुर्रियत नेता और अरुंधती के खिलाफ निचली अदालत में पहले से ही दो शिकायतें दर्ज हैं।

अमर और जया को सुप्रीम कोर्ट से राहत

सुप्रीम कोर्ट ने सोमवार को समाजवादी पार्टी के पूर्व नेता व सांसद अमर सिंह और जयाप्रदा को राहत दे दी। कोर्ट ने आदेश दिया कि पार्टी विप का उल्लंघन करने पर दल बदल विरोधी कानून के तहत दोनों के खिलाफ कार्रवाई नहीं की जा सकती।

जस्टिस अल्तमस कबीर और जस्टिस सी. जोसेफ की बेंच ने यह सवाल बड़ी बेंच को रेफर कर दिया कि क्या पार्टी से निकाल दिए गए किसी सदस्य को पार्टी विप का उल्लंघन करने पर दल बदल विरोधी कानून के तहत अयोग्य ठहराया जा सकता है। अमर और जया को 2 फरवरी को पार्टी से निष्कासित कर दिया गया था। बाद में दोनों को असंबद्ध सांसद घोषित कर दिया गया था।

CAT says 'OBC quota only for fresh recruits'

Ruling that the OBC quota policy is applicable only for fresh appointments, the Central Administrative Tribunal (CAT) has said the benefit cannot be claimed for posts that are filled by promotion. The ruling came from a CAT bench of chairman VK Bali and vice-chairman LK Joshi on a petition by Income Tax Appellate Tribunal (ITAT) member Sunil Kumar Yadav, who complained that the government was not following the OBC quota policy for filling the posts of ITAT vice-presidents.
In his petition, Yadav pointed out that, according to a seniority list of ITAT members released on February 2, 2009, for appointments of nine vice-presidents; his name was the 17th. If the OBC quota rule were applied, two of the nine posts would go to OBC candidates, he had contended.
However, rejecting his plea, the CAT said OBC reservation benefits would not apply in filling the key posts, as these were appointments by promotions and not direct recruitments.
According to relevant government rules, reservation will be applicable only for direct recruitment and not in case of promotion, CAT emphasised.
"It is conceded position that, if at all 27% reservation is to be made for candidates belonging to OBC category, it would be applicable only as regards direct recruitment and not promotion," the CAT said.
Explaining what constituted a promotional appointment, the bench said: "If the list of candidates called for selection was only of serving employees and no claim of any outsider was considered, the same is not a direct recruitment but selection and appointment on the basis of promotion."
In his petition, Yadav alleged that the central government prepared the list of candidates for ITAT vice-presidents without complying with the mandate of reservation for OBC citizens envisaged under articles 16(4) of the Constitution.
Yadav had said the post of vice-president is a civil post, and is not classified as, scientific or technical post, which is out of the purview of reservation law.

सुप्रीम कोर्ट ने वोडाफोन को दिया बड़ा झटका

सुप्रीम कोर्ट ने वोडाफोन को इनकम टैक्स मामले में 2,500 करोड़ रुपए और 8,500 करोड़ रुपए की
बैंक गारंटी जमा करने का आदेश दिया है।
ब्रिटेन की इस कंपनी पर हचिसन के अधिग्रहण के मामले में 11,000 करोड़ रुपए टैक्स देनदारी का मामला चल रहा है। सुप्रीम कोर्ट के मुख्य न्यायाधीश एस. एच. कपाड़िया ने वोडाफोन को तीन हफ्ते में 2,500 करोड़ रुपए और आठ हफ्ते में 8,500 करोड़ रुपए की बैंक गारंटी जमा कराने का आदेश दिया। सुप्रीम कोर्ट की खंडपीठ में शामिल न्यायमूर्ति के. एस. राधाकृष्णन और न्यायमूर्ति स्वतंत्र कुमार ने कहा कि अगर यह मामला वोडाफोन के पक्ष में जाता है,तो सरकार कंपनी को ब्याज के साथ जमा कराई गई रकम वापस करेगी।
सुप्रीम कोर्ट इस मामले की अंतिम सुनवाई 5 फरवरी 2011 से शुरू करेगी।
कोर्ट ने इंटरनैशनल टैक्स मामलों के महासचिव को भी निर्देश दिया है कि वह अदालत में यह हलफनामा दायर करे कि अगर इसमें वोडाफोन की जीत होती है, तो सरकार कंपनी को ब्याज के साथ सारा पैसा वापस करेगी। उल्लेखनीय है कि वोडाफोन द्वारा टैक्स नोटिस की स्टडी करने के लिए और समय मांगे जाने के बाद सुप्रीम कोर्ट ने 25 अक्टूबर को मामले की सुनवाई टाल दी थी।
सुप्रीम कोर्ट के निर्देशों के बाद इनकम टैक्स डिपार्टमेंट के स्रोत पर कर कटौती (टीडीएस) अधिकारियों ने विदेशी सौदे पर वोडाफोन की देनदारी तय की थी। विभाग ने वोडाफोन को हचिसन के अधिग्रहण मामले में टीडीएस नहीं करने का जिम्मेदार ठहराया था और टैक्स के तौर पर 11,000 करोड़ रुपए का दावा किया था।

आंध्र प्रदेश के पूर्व गवर्नर नारायण दत्त तिवारी पर लगा 75 हजार रुपये हर्जाना

दिल्ली हाई कोर्ट ने आंध्र प्रदेश के पूर्व गवर्नर नारायण दत्त तिवारी की उस अर्जी को खारिज कर दिया जिसमें उन्होंने सिंगल बेंच के फैसले को चुनौती दी थी। सिंगल बेंच ने तिवारी पर 75 हजार रुपये का हर्जाना लगाया था।
हाई कोर्ट की डबल बेंच ने सिंगल बेंच के फैसले को सही ठहराया है। सिंगल बेंच के सामने तिवारी ने याचिकाकर्ता द्वारा दाखिल अर्जी के कुछ पार्ट को हटाने की मांग की थी। सिंगल बेंच ने तिवारी की दलीलों को खारिज करते हुए उन पर 75 हजार रुपये का जुर्माना लगाया था। सिंगल बेंच के फैसले को तिवारी ने डबल बेंच में चुनौती दी थी।
याचिकाकर्ता ने आरोप लगाया है कि तिवारी उनके बॉयोलॉजिकल पिता हैं ऐसे में तिवारी का डीएनए टेस्ट कराया जाना चाहिए। इस याचिका पर सुनवाई के दौरान तिवारी की ओर से कहा गया था कि याचिकाकर्ता ने बाद में कुछ लाइन अर्जी में बढ़ा दी है ऐसे में उसे हटाया जाना चाहिए लेकिन तिवारी की दलीलों को खारिज करते हुए सिंगल बेंच ने तिवारी पर हर्जाना लगा दिया था।
याचिकाकर्ता की उस अर्जी पर अभी फैसला आना बाकी है जिसमें उसने तिवारी का डीएनए टेस्ट कराने की मांग करते हुए दावा किया है कि वह तिवारी के बॉयोलॉजिकल बेटे हैं।

इनकम टैक्स कमिश्नर के खिलाफ वॉरंट जारी

उत्तरप्रदेश के कानपुर में इनकम टैक्स कमिश्नर के खिलाफ धोखाधड़ी के मामले में मुख्य न्यायिक मैजिस्ट्रेट की अदालत ने गैरजमानती वॉरंट जारी किए हैं। कमिश्नर इसके बाद से ही अपने घर से फरार है। गौरतलब है कि आरोपी कमिश्नर यूपी के पूर्व मुख्य सचिव अखंड प्रताप सिंह का दामाद है।

इनकम टैक्स कमिश्नर भारतेंदु प्रताप सिंह पर अपने विभाग की दो महिला अधिकारियों को परेशान करने के लिए कुछ सांसदों और विधायकों के लेटर पैड का गलत इस्तेमाल करने का आरोप लगाया गया है। पुलिस के अनुसार सांसदों ने महिला पुलिस अधिकारियों की शिकायतें करने से इनकार कर दिया है। उन्होंने यहां तक कहा है कि यह लेटरपैड भी उनका नहीं है।

एक विधायक ने दावा किया कि उसने अपने नाम के कुछ लेटरपैड अपने एक सहयोगी को दे दिए थे, जिसे उन्होंने कमिश्नर को देना कबूल किया है। कोर्ट में गवाहों के बयान रेकॉर्ड होने के बाद पिछले साल 4 नवंबर को अदालत ने कमिश्नर की गिरफ्तारी का वॉरंट जारी किया था। यह मामला इतने दिनों तक ठंडे बस्ते में कमिश्नर के प्रभाव के कारण पड़ा गया। कमिश्नर के ससुर अखंड प्रताप सिंह यूपी के मुख्य सचिव रह चुके हैं।

सूत्रों के अनुसार अखंड प्रताप सिंह को धोखाधड़ी और आय से अधिक हजारों करोड़ की संपत्ति अजित करने के आरोप में सीबीआई गिरफ्तार कर जेल भेज चुकी है। उनके खिलाफ चार्जशीट भी दाखिल की जा चुकी है। जब पुलिस से पूछा गया कि इतने दिन बीतने के बाद भी इनकम टैक्स कमिश्नर पर कोई कार्रवाई क्यों नहीं आई। इस पर पुलिस के एक वरिष्ठ अधिकारी ने कहा कि वॉरंट जारी होने के बाद ही इनकम टैक्स कमिश्नर फरार है। इसलिए गिरफ्तारी नहीं हो सकी।

हालांकि सूत्रों का आरोप है कि आरोपी कमिश्नर को मायावती सरकार के एक टॉप ब्यूरोक्रेट का संरक्षण हासिल है। सीबीआई के जांच अधिकारी ने सांसद जफर अली नकवी और धनंजय सिंह के लेटरपैड का दुरुपयोग होने की पुष्टि की। उन्होंने कहा कि इसके अलावा विधायकों सुंदर सिंह और गणेश शंकर पांडेय के लेटरपैड का भी गलत इस्तेमाल हुआ है।

Sections under which a Case filed against Rakhi Sawant

A case has been registered under section 306,504 and 120 of Indian Penal Code against item girl Rakhi Sawant and four others in Uttar Pradesh’s Jhansi town in connection with the death of a participant allegedly after being humiliated by her at the reality show 'Rakhi Ka Insaaf'.
The FIR was registered at the Premnagar police station in Jhansi on Friday, police sources here said. Rakhi and four others have been charged with provoking to commit suicide besides other sections of the IPC. A youth Luxman had allegedly went into depression and later died after he was humiliated by Rakhi in her reality show last month.
Luxman, who hailed from Raigarh area in Jhansi about 300 km from here, had participated in one of the episodes of “Rakhi Ka Insaaf” last month during which the actress had reportedly called him a “namard” (impotent).
Luxman had some differences with his wife Anita following which the latter had left him to live with her parents a few months ago. “Anita had alleged that a member of Luxman’s family had tried to rape her,” the family members said. The organisers of the show invited Luxman and his wife to take part in the show to resolve their differences. Instead he was called an impotent much to his shock.
Luxman went into depression after the show was aired on a TV channel and was watched by his friends and neighbours. He died on Wednesday. His family members alleged that Luxman’s death was in fact a suicide after being humiliated by the item girl.

If any person commits suicide, whoever abets the commission of such suicide, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Section 120 Concealing design to commit offence punishable with imprisonment
Whoever, intending to facilitate or knowing it to be likely that be will thereby facilitate the commission of an offence punishable with imprisonment,
voluntarily conceals, by any act or illegal omission, the existence of a design to commit such offence, or makes any representation which he knows to be false respecting such design,
If offence be committed-if offence be not committed- shall, if the offence be committed, be punished with imprisonment of the description provided for the offence, for a term which may extend to one-fourth, and, if the offence be not committed, to one-eighth, of the longest term of such imprisonment, or with such fine as is provided for the offence, or with both.

पति की कम पढ़ाई के चलते तलाक

मास्टर ऑफ कंप्यूटर ऐप्लिकेशन (एमसीए) का कोर्स करने वाली लड़की ने घर वालों द्वारा देखे गए लड़के से शादी तो कर ली, लेकिन उनकी ज्यादा निभ नहीं पाई। लड़का कोई कामधंधा भी नहीं करता था। लड़की को पति की बेरोजगारी और उसकी कम एजुकेशन सालने लगी। इसके चलते पति-पत्नी के बीच मनमुटाव रहने लगा। इस बीच लड़की पति का घर छोड़कर अपने मायके चली गई। लड़की ने पति से तलाक लेने के लिए कोर्ट का दरवाजा खटखटाया। वहीं पति ने उसे वापस लाने के लिए कोर्ट में अर्जी दाखिल कर दी। मध्यस्थता सेंटर में दोनों पक्ष आपसी रजामंदी से तलाक लेने के लिए तैयार हो गए।
नॉर्थ ईस्ट डिस्ट्रिक्ट में रहने वाली रिचा की 8 मार्च 2008 को रोबिन (दोनों बदले हुए नाम) शादी हुई थी। रिचा ने एमसीए की हुई है, जबकि उनके पति सिर्फ बारहवीं क्लास पास है। इतना ही नहीं रोबिन कोई काम धंधा भी नहीं करते थे। वह अपने भाई के साथ उनके बिजनेस में हाथ बंटाते थे। शादी के तीन महीने बाद भाभी ने उनकी ऑफिस में एंट्री बंद कर दी थी। रिचा ने अपनी एमसीए की डिग्री का फायदा उठाते हुए पति के साथ मिलकर सॉफ्टवेयर कंपनी बनाई। कंपनी का काम शुरू होते ही रोबिन ने पत्नी के ऑफिस आने पर रोक लगा दी। लिहाजा रिचा ने किसी कंपनी में जॉब कर ली। बावजूद इसके छोटी-छोटी बातों को लेकर पति-पत्नी के बीच झगड़ा रहने लगा।
परेशान होकर रिचा पति का घर छोड़कर अपने मायके चली गई। इसके बाद रिचा ने नंद नगरी स्थित महिला अपराध शाखा में पति के खिलाफ कंप्लेंट कर दी। यही नहीं रिचा ने सितंबर 2010 में कड़कड़डूमा स्थित अडिशनल डिस्ट्रिक्ट जज पी. के. मट्टू की अदालत में तलाक की अर्जी दाखिल कर दी। वहीं दूसरी तरफ रोबिन ने पत्नी को वापस ले जाने की एप्लिकेशन दायर कर दी।
अडिशनल डिस्ट्रिक्ट जज ने पहली ही सुनवाई पर उनका केस मध्यस्थता सेंटर में रेफर कर दिया। जहां मीडिएटर तिलकराज अरोड़ा ने दोनों पक्षों के मन को टटोलने के लिए उनसे अलग-अलग बातें की। लड़की का कहना था कि उनका पति कम बढ़ा लिखा तो है ही साथ ही वह कोई काम धंधा भी नहीं करता था। उसने पति को कामयाब बनाने के लिए अपनी सॉफ्टवेयर कंपनी बनाई, लेकिन पति ने उसके चरित्र पर शक करना शुरू कर दिया। इसके चलते उसे पति का घर छोड़ना पड़ा।
रिचा ने मीडिएटर से कहा कि अब वह फैसला कर चुकी है कि वह इस इंसान के साथ अपना पूरा जीवन नहीं बिता सकती, इसलिए उसे तलाक चाहिए। वहीं दूसरी तरफ रोबिन ने मीडिएटर से कहा कि झगड़े के कुछ दिन बाद वह अपनी गलती मान लेता था, लेकिन उसकी पत्नी हमेशा पुरानी बातों को कुरेदती रहती थी। इतना ही नहीं वह पूरी तरह से अपनी मां, बहन और जीजा के प्रभाव में रहती थी। रोबिन का कहना था कि वह सैकड़ों लोगों की मौजूदगी में अपनी पत्नी से माफी मांगकर उसे घर ले जाने के लिए तैयार है। उसकी बातें सुनने के बाद न केवल मीडिएटर बल्कि दोनों पक्षों के वकीलों ने लड़की से एक बार फिर अपने फैसले पर पुनर्विचार करने के लिए कहा, लेकिन लड़की अपने फैसले से टस से मस नहीं हुई।
इस तरह से सिर्फ दो तारीखों में मध्यस्थता सेंटर ने पति - पत्नी के बीच तलाक के लिए समझौता करा दिया। समझौते के मुताबिक लड़के को 50 हजार रुपये के साथ - साथ एक महीने के भीतर दहेज का सारा सामान वापस लौटाना हो गा।

Today Supreme Court has held that A woman in a live-in relationship is not entitled to maintenance unless she fulfils certain parameters, the Hon’ble also observed that merely spending weekends together or a one night stand would not make it a domestic relationship. Supreme Court lays down conditions for women seeking maintenance in live-in relationships.
A bench comprising Justices Markandey Katju and T S Thakur said that in order to get maintenance, a woman, even if not married, has to fulfil the following four requirements:
(1) The couple must hold themselves out to society as being akin to spouses
(2) They must be of legal age to marry
(3) They must be otherwise qualified to enter into a legal marriage including being unmarried
(4) They must have voluntarily cohabited and held themselves out to the world as being akin to spouses for a significant period of time.
"In our opinion, not all live-in relationships will amount to a relationship in the nature of marriage to get the benefit of the Act of 2005 (Protection of Women from Domestic Violence Act). To get such benefits the conditions mentioned by us above must be satisfied and this has to be proved by evidence.
"If a man has a 'keep' whom he maintains financially and uses mainly for sexual purpose and or as a servant, it would not in our opinion be a relationship in the
nature of marriage," the court said.
"No doubt the view we are taking would exclude many women who have had a live-in relationship from the benefit of the 2005 Act (Protection of Women from Domestic Violence Act) but then it is not for this court to legislate or amend the law. Parliament has used the expression 'relationship in the nature of marriage' and not 'live-in relationship'. The court in the garb of interpretation cannot change the language of the statute," the bench observed.

जज बनना चाहते हैं? कंप्यूटर भी सीखिए

सुप्रीम कोर्ट ने कहा है कि जजों को नियुक्ति के वक्त कंप्यूटर की बुनियादी जानकारी होनी चाहिए और अगर कोई कैंडिडेट इस शर्त को पूरा करने में नाकाम रहता है तो उसे भर्ती से वंचित किया जा सकता है।
जस्टिस मुकुंदकम शर्मा और जस्टिस ए. आर. दवे की बेंच ने यह व्यवस्था सिविल जज बनने की इच्छा रखने वाले उम्मीदवार विजेंद्र कुमार वर्मा की याचिका को खारिज करते हुए दी। वर्मा ने अपनी याचिका में उत्तराखंड सरकार के उस फैसले को चुनौती दी थी,जिसमें उनकी उम्मीदवारी को इस आधार पर खारिज कर दिया गया कि वह कंप्यूटर की बुनियादी जानकारी दिखाने में कामयाब नहीं रहे।
बेंच ने अपने फैसले में कहा कि यह समझा जाना चाहिए कि भारतीय जुडिशरी अदालतों के कारगर प्रबंधन के लिए ई-गवर्नेंस लागू करने के लिए कारगर कदम उठा रही है। निकट भविष्य में देश की सभी अदालतें कंप्यूटरीकृत की जाएंगी। उस संदर्भ में नए नियुक्त होने वाले जजों से उम्मीद की जाती है कि उन्हें कंप्यूटर की बुनियादी जानकारी होगी। बेंच ने कहा कि जज बनने के लिए कंप्यूटर की बुनियादी जानकारी होने की अनिवार्य शर्त की अनदेखी करना अनुचित होगा। इसलिए हमारी राय है कि कंप्यूटर की बुनियादी जानकारी होने की अनिवार्य शर्त को हल्का नहीं किया जाना चाहिए।
वर्मा ने उत्तराखंड जुडिशल सर्विस के नियम आठ के तहत सिविल जजों की सीधी भर्ती के लिए योग्यता मानदंडों को चुनौती दी थी। उसमें लॉ की डिग्री के साथ हिंदी और कंप्यूटर की बुनियादी जानकारी होने की शर्त रखी गई थी।

Women labourers to get Rs 3000 as maternity benefit in UP

The Uttar Pradesh government has launched three schemes for construction workers, including a maternity benefit plan under which a woman will get Rs 3000. A compensation of Rs 40,000 will be given to registered construction workers in case of accidents leading to permanent disability or death, according to a statement released by the office of Labour Commissioner recently.
Under this accident aid scheme, registered construction workers or their family will get Rs 20,000 in case of partial disability. This amount will be apart from the aid given under Workers Compensation Act and Workers State Insurance Scheme.
The government has also launched a maternity benefit scheme for women labourers and an infant benefit scheme for the registered labourers, it said. All women labourers registered as beneficiary can avail the benefits of maternity benefit scheme under which Rs 3000 will be given on producing the delivery certificate.
Under the infant benefit scheme, a woman will get Rs 4000 in case of birth of a girl child and Rs 3000 for a boy. The benefits are limited for up to two children and the aid will be given as a one-time amount for two years.
The labourers can apply for these schemes by filling the application forms available in the district labour, block development and tehsil offices. The Labour Commissioner said all construction workers should get themselves registered to benefit from these schemes.

How ex-CJI’s sons got prime plot they had never bid for

The two sons of former chief justice of India Y K Sabharwal, who are being probed for their previous business deals, suddenly came to buy a Rs 122 crore property in Lutyens’ Delhi four months ago, thanks to a series of controversial orders passed by the Delhi high court.

Chetan and Nitin Sabharwal, together with their partner Kabul Chawla, chief of real estate company BPTP, turned out to be the ultimate beneficiaries of high court orders passed since 2006 in connection with the auction of the 2.70-acre property at 7 Sikandra Road.

An appeal challenging the April 2010 sale deed revealed that the three partners had not participated in an auction in September 2006 on which a two-judge bench declared Triveni Infrastructure the highest bidder.

An appeal challenging the April 2010 sale deed revealed that the three partners — Chetan and Nitin Sabharwal, together with their partner Kabul Chawla, chief of real estate company BPTP — had not participated in an auction in September 2006 on which a two-judge bench declared Triveni Infrastructure the highest bidder.

Triveni was required to pay 25% of its bid amount, Rs 117 crore, within a week and the balance within three weeks thereafter, subject to the condition of the property being converted from leasehold to freehold.

But Triveni became liable to pay the 75% component only in February 2009 as it had taken so long for the property to be converted to freehold. It was then that a succession of single-judge orders, in breach of the schedule laid down by the larger bench, resulted in the payment being finally made, with a Rs 5 crore penalty, in April 2010, that too by the two Sabharwals and Chawla although they had no formal stake in Triveni.

The appeal being heard by a special bench headed by Justice A K Sikri shed light on the various ways in which the 2006 order had been bypassed, particularly by Justice Manmohan Singh, leading to a windfall for the Sabharwal brothers and Chawla:

When the owners of the property filed a contempt application against Triveni for its failure to pay the balance in February 2009, Justice Manmohan Singh gave more time to the defaulter directing that it would have to pay Rs 3 crore by July-end and Rs 85 crore by October-end. Later, he extended the time further to December-end with a penalty of Rs 5 crore.

The repeated extension of the deadline by Justice Manmohan Singh was contrary to the division bench’s direction that if the highest bidder failed to make the payments on time, the property would have to be sold to the next highest bidder, Prime Commercial.

In June 2009, Justice Manmohan Singh allowed a fourday old company, Angle Infrastructure, to come in place of Triveni for paying the balance and to take over the property. The owners of the property appealed against this order as it had been passed without any notice to them.

A week before the expiry of the December 2009 deadline, Justice Manmohan Singh gave a fresh extension to Angle, this time by five months. He also granted Angle’s request to introduce the condition that it would be required to pay the balance only when the owners were in a position to deliver immediate possession of the property. Most of the owners challenged this order, again because it had been passed without any notice to them.

A month before the expiry of the May 2010 deadline, Triveni and Angle filed a joint application requesting that the balance be allowed to be paid by the Sabharwals and Chawla and that the property be registered in their names. Since the Sabharwal brothers and Chawla appeared in the court with demand drafts of the balance amount, Justice Rajiv Shakdher directed the owners on April 20 to execute the sale deed within two days.

That is how the Sabharwal brothers and Chawla acquired the property from an auction in which they had not participated at all.

The appeal filed subsequently by the second highest bidder, Prime, challenged the manner in which the court had granted undue concessions to Triveni and deprived it (Prime) of its entitlement under the auction terms to buy out the property. Seeking a fresh auction of the Sikandra Road property, Prime offered to pay Rs 150 crore in keeping with the appreciation of the property value in these four years.

The real estate business partnership between the Sabharwal brothers and Chawla has been the subject of income tax probe following allegations that they had unduly benefited from the 2006 sealing drive against commercial properties in residential areas of Delhi launched by the then CJI, Justice Y K Sabharwal.

HC: No sympathy for tenants who regularly default on rent payment

No sympathy should be shown to a tenant who is a habitual defaulter in paying rent, the Delhi high court said recently, while asking a businessman to vacate the premises belonging to NDMC. ‘‘Every licencee or allottee and even an unauthorised occupant is obliged to pay the monthly licence fee so long he is using the premises. No undue sympathy can be shown to those who wilfully and contemptuously commit persistent defaults in paying periodical rents,’’ Justice Kailash Gambhir noted in a recent judgment. HC dismissed a petition filed by one Vijay Kumar who challenged the NDMC’s decision of rejecting his application for regularisation of shop allotment under its 1997 policy. Kumar also challenged the eviction order passed by the estate officer against him.

HC, in its verdict, gave 15 days’ time to Kumar to vacate the premises, UG-40 Palika Place, R K Ashram Marg. It asked the civic agency not to take coercive action against him till then.

HC upheld NDMC’s decision refusing to regularise Kumar’s shop. It rejected his argument that the civic agency adopted a pickand-chose policy while regularising allotment of shops. According to NDMC, Kumar was allotted the shop in 1992 for five years. His application for renewal of his shop’s licence was rejected in 1998 due to non-payment of rents.

The petitioner was in arrears for licence fee/rent to the tune of Rs 1,32,431 as on November 15, 2007, the date on which the estate officer had ordered for eviction of the shop, as per NDMC. Kumar had filed a case before the district judge who dismissed his petition in July 2009 and upheld the estate officer’s decision for eviction.

22 Yrs On, He Moves SC Fighting For Adequate Pension

The judiciary’s efforts to clamp down on corruption may seem to have slackened with those who allegedly siphoned off crores of rupees from the PF accounts in Ghaziabad district court continuing to enjoy office but in 1988, a Gujarat chief judicial magistrate was dismissed from service for paying Rs 65 less towards taxi fare while on a private visit with family.

The judge, P N Bavishi, has now approached the Supreme Court. A bench comprising Justices J M Panchal and C K Prasad admitted his petition after hearing his counsel Haresh Raichura narrate a nearly two-decade fight by the judicial officer for proper pension, which he claimed the state government had refused to give.

Bavishi, who joined judicial service in 1963, was working as CJM Junagadh in 1981 when he took his family on a private trip to various places and the taxi bill came to Rs 120. But he allegedly paid Rs 55 to the taxi operator, who then complained to the HC.

The HC termed this a grave misconduct on the part of a judicial officer as he allegedly misused his official position to pay less to the taxi operator and ordered Bavishi’s dismissal. He challenged this administrative order on the judicial side.

During the hearing in SC, the government counsel said the HC, on the administrative side, agreed to permit the petitioner to retire voluntarily from service from the date of his removal if he made an application to this effect. Bavishi withdrew the petition and made an application for voluntary retirement as was suggested.

The HC recommended his case. The government accepted the same and cancelled its earlier notification dismissing Bavishi from service. However, it refused Bavishi the benefit of weightage of additional service as was granted to others according to government rules.

Since his voluntary retirement in 1992, Bavishi has been fighting for consideration of weightage of his service while fixing pension. The HC rejected his plea but the SC has now agreed to hear his case.

Bavishi’s main plea was that once the HC accepted his request and recommended his case for voluntary retirement, the state government could not overreach this order.

FIRs against minister for anti-dalit remarks

Kendrapara: Agriculture minister Damodar Rout will be interrogated for the antidalit remarks he allegedly made last week.

‘‘We will soon interrogate the minister after two dalit leaders filed FIRs against him with Kujang (Jagatsinghpur) police. After examining the contents of the FIRs, police filed case against the minister on Monday under Section-3 of SC and ST (Atrocity Prevention) Act, 1989. Police are also examining the videotape of the statement made by the minister at a public meeting,’’ sub-divisional police officer (SDPO) of Paradip Santun Das said.

Last Wednesday, Rout had allegedly levelled Jagatsinghpur MP and CPI leader Bibhu Prasad Tarei, Jagatsinghpur MLA and former minister Bishnu Das and additional district magistrate Upendra Mallick as ‘‘Harijans’’, who hatched a conspiracy against him.

Actor Asha Parekh booked for forgery in labour dispute case

Police have booked former Bollywood actor Asha Parekh and film producer Sunil Shanbag under on charges of forgery and criminal breach of trust. Tardeo police registered an FIR following a private complaint by art director Krishna S Singh before the metropolitan magistrate. ‘‘We will file a report before the magistrate,’’ said police.

Parekh said she was not aware of the details of the complaint. The case is related to a labour dispute between Singh and her former employer, A Pattanaik, who runs a firm, Designworks, over her claim for Rs 2.05 lakh as dues. According to the complaint, salary certificates paid to Krishna by Parekh’s company Aakruti Productions and Shanbagh’s Chrysalis Films were produced before the assistant labour commissioner by Pattanaik.

Krishna alleged that this was done to negate her claims. Krishna lodged a private complaint under Section 156 (3) of the Criminal Procedure Code with the Girgaon magistrate’s court. ‘‘Taking into consideration the serious allegations against the accused, it needs a detailed investigation,’’ said additional chief metropolitan magistrate Shaida Razvi. The matter is scheduled to come up before the magistrate on August 26.

Gzb court sentences two to 5-yr RI for cruelty to animals

In a rare order, a Ghaziabad court on Monday sentenced two persons to 5 years of rigorous imprisonment for violation of the Prevention of Cruelty to Animals Act and some sections of the Indian Penal Code.

The two convicts had been accused of setting on fire a cattle shed in Modinagar. This resulted in the deaths of a cow and a buffalo belonging to one Om Pal of Jagatpuri in the subdivision of Ghaziabad district.

According to the state counsel for the prosecution, Pramod Kumar Tanwar, Om Pal of Jagatpuri had filed a report at the Modinagar police station on July 17, 2007. The report said Jagatpuri residents, Shiv Ram and Lokesh, set his cattle shed on fire while he and his family were asleep at night. The fire spread and engulfed the whole cattleshed, and left Om Pal’s cow and buffalo dead. A case was then registered under Section 11 of the Prevention of Cruelty to Animals Act, and Sections, 428, 429 and 436 of the Indian Penal Code, the last three dealing with mischief resulting in damage to or death of animals.

After a trial, additional district judge R N Singh of fast track court number 7 sentenced the two accused.
